Wf-�RF,AS, the Plann�ng CaYtuY►ission of the City of Cupextino reoeived an
application for a Use Permit, as described on Page 1 of this Resolution; ar�d
WI�2E',AS, the applicant has met the burden of proof required to support said
application; and
Wf�ID.2E'AS, the Planning Connnission made the folloowing findings:
a) The exparlsion of the parking lot is only to meet the existing parking
dexnand.
b) The parking lot will be improved aesthetically by the addition of
landscaping and the reconfiguration of the parking stalls.
c) The entry drive width is less than the city star�da.rd but aoceptable
to the City F�igineer because vehicles are only 6 feet wide.

evidence sul�nitted in this matter, the application for Use Permit is hereby
rec�ranended for approval; and

Application 12 U-91 as set forth in the Minutes of the Planning Ccarnnission
Nieeting of December 9, 1991, and are incorporated by reference as though fully
set forth herein.

1. APPROVID E�IIBITS
The reco7rnnendation of approval is based on the Design Developanent Plan
dated revised 12/4/91 except as may be amended by the conditions oontained
herein.

2. MODIFICATION OF APPROVID DEVEGOPN�FI' PLAN
In the event that the applicant or subsequent property c�wnex shall desire
to make any minor changes, altexations or amer�nt of the appraved
developan�ent plan, a written request or revised developanent plan shall be
su�iiitted to the Director of Community Develo�anent. If the Director makes
a finding that the changes are minor and do not result in a material
affect upon the appearance or function of the project, said changes may be
certified on the revised plan. If approval of said chariges is withheld,
the applicant may appeal to the Planning Crn�unission.
If the director finds that the requested cl�anges are material, such c�ariges
shall be referred to the Planning Commission for approval. If the changes
are denied by the Planning Co�nnission, the applicant may appeal to the City
Council as provided in City Ordinance No. 6652.
3. HANDICAPPID PARKING
The required n�r of harxiicapped parking spaces is 4, per sec,-tion 7102 of
the California Accessibility Standards.
4. LANDSCAPING
The applicant shall su�eiiit a cx�mprehensive landscaping plan for
Archit.ectural and Site Conunittee approval. Said plan shall be in
conformance with Xeriscape guidelines. Any subsequent planting, once the
plan has been approved, should be limited to the planting of trees per
Ordinance #8387. All existing speciman trees shall remain.
5. EN1�2Y P'YLpNS�PAVERS
'I'he design, color, and any signs that would appear on the pylons require
Architectural and Site Connnittee approval.

6. IIaIRY PYIANS
The placement of the entry pylons and pavers is subject to approval by the
Public Works Departmrnent. Special concerns include the placement with
regard to the prop�x line and easements.
