� Wfi�ZE'AS, the Planning C�unission of the City of Gvp�rtino has reoeived an
application for an A�nt to the General Plan, as described on Page 2 of
this Resolution; atyd
Wf��2F'�AS, the necessary public notices have been given in aocordance with the
Prooedural Ordinance of the City of Cupertino, an�d the Planning CoaYnnission has
held one or more Public Hearings on the subject ap�lication; ar�d
WFIEREA,S, the Planning Cce�mtission fitX3s that the General Plan Ame.n�ment is
justified acoording to the follvwing facts and conclusions:
1) The proposed Amexx�me.nt represents an unforeseen trerid in land use
which was not considered at the t�me the General Policies for Monta
Vista were included in the General Plan. A shrinkirig demand in
retail marketing space autside of the City's oore e�loyment area
renders continued reservation of the spaoe for business uses as the
pr�m�ary activity infeasible.
2) The existing General Plan policy requiring cc�miercial uses as the
primary use is outdated, given the presenoe of the new postal center
` in the Monta Vista area and the subseq�ie,nt redefinition of business
trade area which that use im�oses on the neic�borhood.

That after careful oonsideration of maps, facts, exhibits, testim�ny and other
� evidence suxmitted in this matter, the application for Amen�n�nt of the General
Plan to allvw residential use as the primary on site activity is hereby
reca�ranPx�ded for approval; and
