WHmF'AS, the Plannix�g C7cemnission of the City of Cupertino reoeived an
application for a Use P�mit, as described on Page 2 of this Ftesolution; and
W�EAS, the applicant has met the burden of proof required to support said
application.; and
WI�2EAS, the Planning Ccarnnission finds that the application meets the
follvwing requireme.nts:

a) That the van pool program as cor�ditioned herein meets the requirements
� of condition 31 of Use P�ermit 32 U 85.
i b) 'Il�at the van pool program is inte.ryded to substantially reduce the
amount of vehicular traffic to ar�d frcan the facility by both residents
aryd e�nployees .
c) That the program, if suooessful, will contribute to the reduction of
air pollution emitted by aut.cenobiles that w�ould otherwise be u��ed.
d) 'That the proposed use is otherwise nat detrimental to the health,
( safety, peaoe, morals ar�d general welfare of persons residing or
working in the neic�borhood of such praposed uses, nor injurious to
praperty and i�raveme.nts in the neic�borhood.

' That after careful oonsideration of maps, facts, exhibits, testim�riy and other
eviderx� submitted in this matter, the application for appraval of a van
Pooling Prog�'an► is hereby approved, subject to the conditions which are
I enwmerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and oonditions specified in
this Resolution are based ar�d oontained in the Public Hearing reoord c�oncerning
Application 32 U 85 as set forth in the Minutes of the Plannirig Ca�nission
M,eeting of August 26, 1991, ar�d are itioorporated by reference as though fully
set forth herein.

� The reocetHner�dation of approval is based on transportation program
de��ription arid emplayee vehicle pooling desczription dated August 7, 1991,
exoept as may be amerided by the oor�ditions contained in this Resolution.
2. ZRANSPORTATION DFI�ND PR�2AM
The applicant shall chose a Ccennrn�te Coordinator within 60 days of
oocupancy. The Ccarnnute Coordinator will be responsible for achninistering
and implementing the 'I�I program.
The Go�mnite Coordinator s1�a11 file a T�K report annually to the City's TDNI
Coordinator to assess the suooe.ss of both proqrams.

The em�layee car pooling proqram will be evaluated by average vehicle
ridership (AVR) goals as follows:
1) By July 1, 1993 the AVR goal shall be 1.18.
2) By July 1, 1995 the AVR goal shall be 1.26.
� 3) By July 1, 1997 the AVR goal shall be 1.33.
If the program does nat meet this goal, the c�nrn�te coordinator, along
with the city TL�I 000rdinator, shall develc�p furthex incentives which may
include, but is not l�mited to a guaranteed ride ho�ne for em�rgency
situations, a subsidized public transit program, and/or further monetary
inoentives.
The resident van pool program will be considered successful if the use of
the service increases in praportion with the rnunber of residents at the
facility over a one year period. If the program does nat appear to be
suc�oessful the applicant, alor�g with the city TUM 000rdinator, shall
develap inoentives and criteria to prcenote its suooess.

3 ) VAN P'��1ASE
� The applicant snall make available upon oocupancy of the project one 20+
passanger van for use far the resident van pool program and e.n�loyee
croarnnute assistarx�e. Subsequent vehicles, as stated in the van pool
desc;ription, may be added as required to adequately serve the residents.
The van ar�d subsequent vehicles shall be kept in good �aorking order and in
c�onformanc�e with all state laws.
