Reso 4347 4-U-91 C I T Y O F C U P E R T I N O 10300 Torre Avenue Cupertino, California 95014 RFSOLUTION No. 4347 OF THE PLANNING C'ON�SSION OF TI� CI'I'Y OF CUPF�2TIN0 RF700NIl�TDING DF�IAL OF A USE P�IIT TO ALLiOW E�TION FROM TI� R�QUIl2II�'I'S OF TI� UNDII�GROUND Ul'ILITY CHAPTF�2 OF THE MUNICIPAL OODE SECTION I• FINDINGS WI�2iEAS, the Planning Co�►unission of the City of C'upertino has received an application for a Use Permit, as described on Page 2 of this Resolution; and WI�REAS, the necessary notices have been given in accordance with the Proc.edural Ordinance of the City of Cupertino, arid the Planning Conmlission has held one or more Public Hearings on this matter; and W�S, the applicant has failed to meet the burden of proof required to support this application, and has not satisfied the following requirements: , 1) Undergrounding utilities ca�nnwzity wide is required to help create a visually attractive, undivided, and natural setting within the City. 2) The view from Fremont-Older Park should be preserved without man made obstructions. Implemetztation of undergrounding can help to obtain this goal. 3) The placement of utilities below grade protectes them from hars�h climatic elements and therefore, adds years of life to these lines. 4) Property dwner must complete their fair share of underground.irig of overhead wiring as will be required on subsequent tentative parcel map of adjoining property owners.
