The Director of Community Development may allow indoor seating without
securing a Use Permtit for consiunption of food items purchased on the
� premises of a retail grocery outlet when the foll�aing guidelines are met:

1) Availability of the seating area cannot be advertised, and table
side waiter/waitress service may not be offered.
' 2) Food items for on premises constunption must be purcllased at the
regular checkout counter. (�ception: If the food item is
purchased at an in-store deli counter or similar sales area whic.h
is under the same managexne,nt control as that of the main sales
, floor, it may then be purchased at a satellite cash register.)
3) Hours of availability for the seating area coincide with hours of
operation for the grocery sales floor.
4) Management of the seating area remains the responsibility of the
grocery operator including removal of litter.
5) The existing parking space inventory for the grocesy outlet site
� is consistent with City Ordinance requirements at the time the
seating area is installed.
6) the ability to provide incidental food service seating does not
apply to "convenience markets" as defined in Sec.-tion 4.2 of
Ordinance 1344.
7) total seating does not exceed a ratio of one (1) seat for every
500 s.f. of gross floor area.

8) no alcoholic beverages will be consLmned in the seating area.
The Director of Co�ununity Development may still require an application for
a Use Permit in any specific case to address explicit matters of community

many of the roqrams which are describ d in the Capital
Improvements bu et will require separate env ronmental assessments

4. INTERPRETATION of Ordinance 1344 to allow for provision of
seating in retail grocery stores for incidental use by
customers for on-premise consumption. of food products
purchased in the store.
Staff Presentation: Mr. Mark Caughey stated the grocery retail
industry is looking for opportunities to place seating inside
stores to accommodate customers buying prepared foods to eat on the
premises. Under interpretation of the Commercial Ordinance such
activity would be deemed a restaurant, which does require Use
Permit review. Mr. Caughey reiterated the guidelines as outlined
in the staff report. Staff feels this operation is self-regulating
and would not evolve into a defacto restaurant as long as the
guidelines were followed.

Chr. Mackenzie expressed concern reqarding people taking advantage
of the situation. Mr. Caughey stated staff could come before the
commission for a re-interpretation of the Ordinance.
The pub2ic hearing was opened.
Mr. Greg Endum supports the interpretation of the Ordinance. He
noted there has been a change in the supermarket industry and it is
economically sound to have eatinq establishments on the premises.
He noted stores have grown to accommodate more services for the
public and noted the seating area would be less that 2 percent of
the floor space in the Marina food store. He spoke in support of
• the guidelines.
Mr. Charles Newman, Cupertino Village, spoke in support of staff's
recommendation
Mr. Don Cochran, resident, stated the seating•in the grocery stores
would be a benefit to the City and convenient to residents. Ile
noted it would cut down on traffic at the 2unch period,
in response to Com. Mahoney's question regarding changing the
interpretation if it does not work, Mr. Kilian stated the
Resolution could be rescinded, however it would be difficult to not
allow an existing establishment to continue. The ordinance could
be changed in the future.
Com. Fazekas felt the problem would be with smaller grocery stores
� and suggested a cap of 4 percent floor space and max of 1 seat per
500 s.f.
Com. Austin expressed concern regarding consumption of alcohol on
the premises.. Mr. Kilian stated a separate license would be
required £or this.
Chr. Mackenzie expressed concern regarding outside seating. Mr.
Caughey stated it is indoor seating only.
Mr. Kilian suggested changing the words "regulatory principles" to
guidelines as an ordinance is not beinq adopted and also a
provision allowing the Director of Planning to require a Use Permit
even though the applicant meets all the guidelines.
MOTION: Com. Fazekas moved to approve the Interpretation of
Ordinance 1344 subject to the findings and subconclusions
of the hearing with the following modifications: Add the
word "indoor" in the title oE the Resolution; Next
paragraph to read "The Directar of Community Development

Dear Mr. Cowan:
At its meeting of March 25, 1991, the Planning
Commission adopted a resolution interpreting Ordinance 1344 to
allow provision of seating in retail grocery stores for
incidental use by customers for on premise consumption of food
products purchased in the store. In adopting the resolution,
the- Cvmmission modified the Staff-recommended proposal in
order to provide that the Director of Community Development
may allow such an incidental use without a use permit,
provided the guidelines set forth in the Commission's
• resolution are met.
The purpose of this letter is to formally request,
pursuant to the Commission's resolution, that you determine
that the Marina Food Store, scheduled to open on Bandley Drive
in mid-April, will be allowed to provide a maximum of 48 seats
in its delicatessen area without necessity of a conditional
use permit. The owners of Marina Foods agree to all of the
six guidelines set forth in the Planning Division's Staff
Report to the Commission (dated March 18, 1991) , as well as
the additional guidelines established by the Commission: that
the seating be indoors, that no alcohol will be consumed in
the seating area, and that the number of seats not excead a
ratio of one seat per 500 square feet of store area. The
Planning.staff is familiar with the details of the proposed
Marina Foods operation. However, if you need any further
information in order to make a determination on this matter,
we would be pleased to provide it to you.

2I. DISCUSSION
Zhe City has been approached by reprasentatives oP several full
seivice grocecy outlets in recent months to define a more expeditious
process for placenent of interior seating in,their establishtmnts for
� the convenience of customers wishing to eat foal products prepared and
purchased on the premises. This activity would be defined as a form
of Restaurant use (Otdinance 1344, Section 4.7 or 4.8), and would
require a separate use perniit approval under Section 6(g).
Since in-store delis, self-serve salad/soup bars arxi ba3ceries offeri.ng
prepared snack food are becx�ming c�nm�on marketing techniques in the
grocery industYy, we believe that a reasonable c�ibination of seating
and food sei-vice can be offered which would not evolve into a defacto
restaurant and which would not require Use Pennit review. We therefore
suggest the followirg guidelines:
1) Availability of the seatirig area cannot be advertised, and table

We have not suggested a criteria which would place a limitation on the
nwnbes of seats offered as we believe the irxlustry would self-regulate
on this point. However, one possible technique would be to establish
a maxitmun percentage of the total sales floor area for incidental
seatinq, if the Cmrmiission firxts that a cap is neoessaty.

Bread of Life Foodstore has recently signed a lease at Cupertino
Village to operate the former Food Villa Market location as a
Bread of Life Foodstore. Bread of Life currently operates a
food store in Campbell.
It is our intention to reopen the store with a minimum of
remodeling. However, we would like to install a small seating
area outside of the food sales area. Customers would be able to
purchase food, pay for it through the checkout stands, and sit
down in a separate seating area located at the front of the
store. The seating area would not be a part of any food service
or food selling area. Please refer to the enclosed drawing.
I am writing now to request a determination as to whether or not
� we would need to apply for a conditional use permit. Since we are
not installing restaurant or foodservice seating, 2 am hoping
that we can avoid a use permit. This would be convenience seating
only.
i would appreciate your consideration of this matter. Please let
me know your determination as soon as possible so that we can
proceed with the opening of the store.
