CbNDITIONS ADN�IISPII2ID BY Tf� PUBLIC WORKS DEPARrl�III�T 1) FIRE HYDRANT Fire hydrants shall be located as required by the City. 2) GRADING 1 Grading shall be approved by the City �gineer in accordance with Ordinance 1143. , 3) NON POINT SOURCE POI.�J'I'ION & DRAINAGE A pollution control program shall be created by the applicant. The program shall address all nonpoint source pollution which may include filtered drain systems and other mechanisms to assure proper waste ' disposal. This information and any other requested information shall be provided to and completed to the satisfaction of the City Engineer. 4 ) UNDEE2GROUND LTI'ILITIFS The developer shall comply with the requiremerits of the Underground Utilities Ordinance No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall sul�nit detailed plans showirig utility underground provisions. Said plans shall be subject to prior approval of the affected Utility provider and the City �gineer. � 5 ) Il`�ROVII�]'I' AGRF�]T The project developer shall entex into a development agreement with � the City of Cupertino providing for payment of fees, including but not limited to checking and inspection fees, storm drain fees, park dedication fees and fees for undergrounding of utilities. Said agreement shall be executed prior to issuance of construction permits. 6) ZRANSFORMERS i Electrical transformers, telephone vaults and similar above ground equipment enclosures shall be screened with fencing and landscaping or located undexground such that said equipment is not visible from public street areas. QONDITIONS ADNIlNISI�EtID BY THE C!ONIl�lUNITY DEVELO�r DEPP�IT�'I' � 7 ) APPROVID EXE-IIBITS The recommendation of approval is based on Exhibits 1-7, dated Novembex 9& November 16, 1990, except as may be amexided by the Conditions contained in this Resolution. 8) MODIFICATION OF APPROVID DEVELiOF�r PLAN In the event that the applicant or subsequent propexty owner shall desire to make any minor clzanges, altexations or amenchnent of the approved developme.nt plan, a written request or revised development plan shall be su�iitted to the Director of Plannirig and Development. If the Director makes a firiding that the changes are minor and do not result in a material affect upon the appearance or function of the project, said changes may be cextified on the revised plan. If � approval of said changes is withheld, the applicant may appeal to the Planning Coirnnission. If the Director finds that the requested changes are material, such � changes shall be referred to the Planning Co�mLission for approval. If the changes are denied by the Planning Co�mlission, the applicant may appeal to the City Council as provided in City Ordinance No. 652. 9 ) TREE PRO'I'ECI'ION The applicant shall provide a plan for preservation of the existing spec�men trees on the subject property affected by development. Said plan shall include graphic depiction of protection devices to be � installed along the dripline perimeter of each tree for the duration of construction activities, including demolition & trailer removal. I 10) LANDSCAPE/IRRZGATION RE'�TIEW The applicant shall sukanit a comprehensive landscape planting plan and irrigation plan for formal review by the Arcllitectural and Site Approval Co7rnnittee prior to issuance of building permits. Said plan shall be in conformance with the City of Cupertino Xeriscape � C�.iidelines. The plan shall have a mixture of deciduous and evergr2PT1 trees. The box size for the trees shall be greater than 24 gallon box. New planting should be directed along the east property line to prohibit views from the substation operations building to the residences, along Hwy 280 if needed and along Blaney Avenue not currently proposed on Plan 3, dated 11/9/90. 11) NOISII�I�1G DEVICFS No public address system or paging system, powered megaphone or similar noisemaking device shall be permitted from the sub-station operations building. � I � R�SOL�TPION NO. 4321 (25-U-90) 1/28/91 Page -4- � I 12) CAR POOL�VAN FOOL The applicant shall agree to create and encourage employees to join a car pool/van pool program. Said program shall provide incentives to employees who join the car/van poolirig program of the applicants choice. 13) AB�NDONID WATER WELLS The property owner shall seal abandoned or unused water wells if the City, after consultation with the Santa Clara Valley Water District, determines that said abandoned or unused water wells have a potential to contaminate the water supply. 14 ) HANDICAP PARKII�TG RDQUIF22IIKIIV�r � The applicant shall meet the State of California Handicap Accessibility Standards. The total minimLUn on-site handicap parking spaces shall be 7 spaces. � 15) SUB-STATION OPERATIONS BUILDING No bay or othex doors are approved for the North elevation of the sub-station operations building. No operating motors or other similar motorized equipment is allowed to be operated in the fenced exterior storage areas designated on said plan. The east exit door shall be designated emergency use only to discourage employee gathering along the east building face. The hours of operation are limited to 7:00 a.m.- 5:30 p.m., Monday through Friday with the e�ception of emergency � use. 1 16 ) LIGI�PING I The applicant shall su�anit final lighting plans for Architectural and Site Approval Conanittee review and approval. Said plan shall include the location of the proposed lighting fixtures (existing & proposed), illwnanire data, pole detail to the satisfaction of the Con�nunity Development Director. I 17 ) ARGE�TECI'URE An elevation of the operations building shall be forwarded to the Architectural and Site Approval Connnittee for review and approval. All roof mounted heatirig and ventilation system should be adequately screened from all public views from Blaney Ave & Blaney Avenue overpass. The screening should match the building in architectural style and color.
