S'I'RE�,�I' TREES Street trees shall be planted within the Public Right of Way and shall be of a type appraved by the City in aocordance with Ordinance 125. 6. Gf2�DING Grading shall be as approved and required by the City �gineer in acoordance with Ordinance 1143. First floor finished floor elevation shall not exceed 24 inches above the highest top of curb elevation on the adjoining Stelling Road frontage, unless the need for greater height is demonstrated to the City �gineer for purposes of achieving proper site drainage or resolving other technical constraints. UNDII�GROUND LTI'IISTIES The dev+elopex� shall camply with the require7ne.nts of the Uriderground Utilities Ordinance No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility � device.s. 'Ihe developer shall su�mit detailed plans showing utility � w�dergraur�d prwisions. Said plans shall be subject to prior approval of the affected Utility provider ar�d the City F�gineex. I 9 . AGREII��1'I' The project developer shall enter into a developament agreement with the City of Cupertino providing for payment of fees, including but not limited to checJcing and ir�spe�-tion fees, storm drain fees, park dedication fees and fees for undergrwnding of utilities. Said agreement shall be executed prior to issuance of construction permits. 10. 2�2ANSFOF�2ER.S Elec,-trical transformers, telephone vaults and similar above ground equipanent enclosures shall be screened with fencing and landsc.aping or located underground such that said equipment is not visible frrnn public street areas. Landscaping in the transformer vicinity shall be adjusted per Condition 10 of Use Permit 16-U-90.
