� WHII2FAS, the Ca�mm�anity Develop�nent Direc.�tor of the City of Cupertino
received an application for a Tentative Subdivision Map, as de.scribed on
Page 2 of this R�solution; and
W�E'.AS, the neoessary public notices have bee.n given as required by the
subdivision and Procedural Ordinances of the City of Cupertino, and the
Director has held at least one Public Hearing in regard to the
application; and
WHERE'AS, the Community Developmn�zt Director finds that the application
meets the follawing requirements:
a) That the parcel consolidation is consistent with the City of
Cupertino General Plan.
b) That the parcel oonsolidation is necessary to implement the physical
developanex�t entitlements granted under application 16-U-90.
c) That the parcel consolidation is not likely to cause substantial
envirormiental damage or injure fish and wildlife or their habitat.
d) That the parcel consolidation and required im�rovements are not
detrimental to the health, safety, peace, morals and general welfare
of persons residirig or working in the vicinity of the subdivision.
e) Zt�at the parcel oonsolidation and its associated improveme.nts will
not conflict with easements aoquired by the public at large for
aooess through or use of praperty within the proposed subdivision.
NOW, �'ORE, BE IT RESOLUF;D:
That upon careful oonsideration of maps, exhibits, facts, test�mony and
other evidence suk�nitted in this matter, the application for Tentative
Map for consolidation of lot lines is hereby approved, subject to the
conditions entm�rated in this Resolution beginning on Page 2 thereof; and
Zhat the subconclusions upon which the findings and conditions specified
in this Resolution are based are contained in the Public Hearing Record
concexning Application 17�Il�I-90 as set forth in the Minutes of the
Ccmurnulity Development Director's meetirig of January 16, 1991 and are
in�rporated by reference as though fully set forth herein.

Street widening, i�rovements aryd dedications shall be provided in
aocordanoe with City Standards arXl specifications as required by the
City Engineer, and in those location indicated on the approved
Tentative Map diagram.
2. CURB AND G'lJITER
Curbs and gutters, sidewalks and related structures shall be installed
in a000rdance with grades ar�d standards as specified by the City
Engineer.
3. SI'RE�I' LIC�iTING INSTAL,i�ATION
Street lighting shall be installed arid shall be as approved by the
city �gineer. Lighting fixtures shall be positioned so as to
precl�de glare and other forms of visual interfere.rx�.e to adjoining
properties.
4. FIRE SAF�I'Y
Developer shall comply with all fire safety requirements specified by
the City in consultation with the Central Fire District.
5. S'I'RE�,�I' TREES
Street trees shall be planted within the Public Right of Way and shall
be of a type appraved by the City in aocordance with Ordinance 125.
6. Gf2�DING
Grading shall be as approved and required by the City �gineer in
acoordance with Ordinance 1143. First floor finished floor elevation
shall not exceed 24 inches above the highest top of curb elevation on
the adjoining Stelling Road frontage, unless the need for greater
height is demonstrated to the City �gineer for purposes of achieving
proper site drainage or resolving other technical constraints.

7. DRAIl�TAGE
I Drainage shall be provided to the satisfaction of the City �gineer.
8. UNDII�GROUND LTI'IISTIES
The dev+elopex� shall camply with the require7ne.nts of the Uriderground
Utilities Ordinance No. 331 and other related Ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
� device.s. 'Ihe developer shall su�mit detailed plans showing utility
� w�dergraur�d prwisions. Said plans shall be subject to prior approval
of the affected Utility provider ar�d the City F�gineex.
I 9 . AGREII��1'I'
The project developer shall enter into a developament agreement with
the City of Cupertino providing for payment of fees, including but not
limited to checJcing and ir�spe�-tion fees, storm drain fees, park
dedication fees and fees for undergrwnding of utilities. Said
agreement shall be executed prior to issuance of construction permits.
10. 2�2ANSFOF�2ER.S
Elec,-trical transformers, telephone vaults and similar above ground
equipanent enclosures shall be screened with fencing and landsc.aping or
located underground such that said equipment is not visible frrnn
public street areas. Landscaping in the transformer vicinity shall be
adjusted per Condition 10 of Use Permit 16-U-90.

11. APPROVID EXEIIBITS
The r�endation of approval is based on the Tentative Map diagram
dated January 15, 1991 of Application 17JIM-90, except as may be
amerrded by the conditions stated in this Resolution.
12. PRIOR O�1�TDITIONS
Nothing in this approval of a tentative map for lot consolidation
p�urposes shall be construed as amending any condition of approval for
Use PeYmit 16-U-90.
