The Planning Coiranission finds that the following amenc�nex�t to said
Condition 1 will relieve uncert.ainties as to the developer's obligation to
fund said improve.ments while still ensuring that the improvements
obligations are completed in accordance with the original project
approvals.
Condition 1 of Use Permit 11-U-90 is hereby reco7rnnended to be amexided as
follaws:
1. S"rREE,'I' Il�ROVII�RIIVTS
Street widening, improvements and dedications shall be provided in
accordance with City Standards and specifications and as required by
the City Engineer.
Said improvement shall include modification of the Mariani
Avenue/DeAnza intersection. East approach im�rovements shall be
implem�alted concurrently with the first phase of project construction.
South approach improvements shall be im�lemented as directed by the
City. To ensure completion of said south approach improvements, the
developer shall provide a Letter of Credit in the amount of $130,000
valid for a period of seven years from the effective date of the use
pe.rmit .
Prior to issuance of building permits for construction of all or any
portion of the approved development, the developer shall provide f��
�¢/¢���/�/�r,���¢�t/��/¢�`�1��t�/��/¢�¢�` suitable financial �j�-�i�i�t�
�� security for widening of the DeAnza Boulevard bridge over Route
2so. The developer shall contribute ����«d��/#�}�/�4�g1/yb��i¢yi�

constructed or 50% of the total widening cost if a new structure is
attached to the existin�v__erpass The maximtun developer contrib�ition
shall be (aunoimt to be by Ci.ty Ooimcil) in either case
which stnn shall be secured by an irrevocable letter of credit prior to
issuance of a building permit. Said maxim�nn develotner contribution
shall be increased yuarterly based on the conswner price inde� for the
San �ancisco Bay Area rec�ion until the time that bid doc�unents for
construction are circulated.
