SE�C.'I'ION I: FINDINGS
Wf�REAB, the Planning Co�nnission of the City of Cupertino received an
application for a Use Permit, as described on Page 1 of this Resolution; and
Wf�iERE'AS, the applicant has met the burden of proof required to support said
application.; and
Wf-�ftE'AS, the Planning Co�nnission finds that the application meets the follc7wing
requirements:
a) That the proposed use arxl existing uses are in conformance with the
General Plan and with the Zoning designation for the site.
b) That the property and building area is of an adequate size and shape
to acco�tnmodate the proposed use .
c) That the proposed use is otherwise not detrimealtal to health, safety,
peace, and general welfare of persons residing or working in the
neighborhood of surh a proposed use.
d) The subject use requires the same parking as the previous use and no
anticipated parking problems are expected.
NOW, �ORE, BE IT RESOLUID:
That after careful consideration of maps, facts, e�ibits, test�mony and other
. evidence suxanitted in this matter, the application for Use Permit is hereby
rec�nn�ed for approval, subject to the conditions which are en�rated in
this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which tlze findings and conditions specified in
this Resolution are based and contained in the Public Hearirig record concerning
Application 6-U-92 as set forth in the Minutes of the Planning C�rnnission
Meeting of September 14, 1992, arxl are incorporated by reference as though
fully set forth herein.

The subject Use Permit grants the operation of a 4,990 sq. ft. pet shop as
outlined in the applicants letter of June 29, 1992, except as amended by
the conditions herein.

Prior to operation of the pet shop the applicant shall obtain all
apprapriate permits fr�m the Santa Clara County Health Dep�rtment.
4. 'I'RA.SH IIJQASiJRFS

Prior to operation of the pet shop all outside trash containers shall be
placed in the trash enclosure provided on the site.
5. I�ING ANIl��ALS OUI'SIDE
It is prohibited for the applicant or ariy future vwner of the pet shop to
keep any animal outside for any length of time except for transportation
