Wf�l2FAS, the Planning Cc¢�unission of the City of Cupertino has received an
application for an exoeption, as described on Page 1 of this Resolution; and
WI�RF'AS, the necessary public notices have been given in accordance with the
Procedural Ordinance of the City of Cupertino, and the Planning Cdnunission has
held one or more Public Hearings on this matter; and
WI�RFAS, the applicant has failed to meet the burden of proof required to
support said application, and has not satisfied the follc�raing requireme,nts:
1) Literal enforc.ement of the provisions of this Ordinance will result in
restrictions inconsistent with the spirit and intent of the Ordinance.
2) The exception to be granted is one that will require the least
modification of the pre��cribed regulation minim�nn variance that will
a�lish the purpose.
3) 'Ihe proposed exception will not result in the hazardous condition for
pedestrians and vehicular traffic.
4) That the exception to be granted is one that will require the least
modification of the pre�scribed regulation and the minim�mi variance that
will accomplish the purpose.

That after careful consideration of maps, facts, exhibits, test�mony and other
evidence sukanitted in this matter, the application for E�ception is hereby
denied; and

That the subconclusions upon which the findings specified in this Resolution
are based are contained in the Public Record concerning Application 1-EXC-91 as
set forth in the Minutes of Planning Commission Meeting of September 14, 1992,
and are incorporated by reference as though fully set forth herein.
