1 WF�RFAS the Pl C7oa«nnission of the City of Cupertino received an

application for a Varianoe, as described on Page 1 of this Resolution; and

Wf�2FAS, the neoessary public notioes have been given in acxordance with the
Prooedural Ordinanoe of the City of Cupertino, ar�d the Plannirig Co�rnnission has
� held at least on Public Hearing on this matter; and
WI�2E'AS, the applicant has met the burd+�n of proof required to support said
application, ar�d has satisfied the firrlings necessary to reoeive approval of
the varianoe request:
� a) The addition will nat create significant off-site impacts.
� b) 'Ihe addition is architecturally oo�q�atible with the existirig structure.
c) The functionalism of the interior spaces will remain usable. The
granting of the Variance will allaw the preservation of the petitioners
pra�rty rights .
d) As viewed fro�n the C�nity Center the addition will appear consistent
with the original building lines.
e) There are exoeptional circ�unstanoes applying to the existing buildirig
that does not apply generally to other similiar homes in the same
district. The tract of hcanes has a mauch larger second story than
norntially oonstructed durir�g the 1970's in this caa�nnunity.

That after careful consideration of maps, facts, exhibits, testimony aryd other
evidexx�e su�mitted in this matter, the application for Variance is hereby
reco�rnnended for appraval, subject to the conditions which are enumerated in
this Resolution beginning on Page 2 thexeof; and
That the suboonclusions upon which the findings and conditions specified in
this Ftesolution are based arid c�ntained in the Public Hearirig reoord concerning
Application 3-V-92 as set forth in the Minutes of the Planning Cormnission
Nieeting of May 11, 1992, ar�d are incorporated by referenoe as though fully set
forth herein.
