Reso 4472 E�ibit D CITY OF CUPERTINO 10300 Torre Avenue Cupertino, California 95014 RESOLUTION NO. 4472 OF TI� PLANNING COMMISSION OF TI� CITY OF CUPERTINO RECO1��IlvIEENDING DENIAL OF A PUBLIC HEARING REQUEST TO CONSIDER A GENERAL PLAN AMENDMENT TO ADD TEXT AND CHANGE A LAND USE DESIGNATION FOR AN APPROXIMATELY 14-ACRE PARCEL ON REGNART ROAD FROM "VERY LOW DENSITY RESIDENTIAL, 5-20 ACRE SLOPE DENSITY FORMULA" TO "VERY LOW DENSITY RESIDENTIAL, SEMI-RURAL 5 ACRE" SECTION L• FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received a request to consider holding a public hearing for a proposed General Plan Amendment as described on Page 2 of this resolution; and WHEREAS, the Planning Commission has review the hearing request in accordance with the adopted General Plan Review Procedure; and WHEREAS, the Planning Commission finds as follows with regard to this hearing request: a) The proposed General Plan Amendment will not benefit the community and is incompatible with the existing General Plan policies and goals of protecting the hillside environment by improving aesthetics; preserving natural resources, such as, wildlife, vegetation watershed potential and open space. b) The proposed Amendment creates a new land use designation and a higher residential density on a steep, hillside property that is contrary to the existing land use designation that limits density to avoid adverse environmental impacts. c) The proposed Amendment does not represent an unforeseen land use trend. Hillside development pressure was well-considered by the City during the General Plan update and the City chose to direct housing development away from the hillsides toward urban core area locations. d) The existing General Plan policies relevant to the subject property are not based on outdated or inaccurate information. The hillside protection policies were formulated in 1992 base on extensive information and testimony provided at numerous public hearings and in recognition of the existing pattern of development and densities. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the public hearing request for this proposed General Plan Amendment is hereby recommended for denial. BE IT FURTHER RESOLVED: That the subconclusions upon which the findings specified in this Resolution are based are contained in the Public Hearing record concerning this request, as set forth in the Minutes of the Planning Commission Meeting of August 23, 1993, and are incorporated by reference as though fully set forth herein.
