Reso 4465 1-U-81 (Modified) CITY OF CUPERTINO 10300 Torre Avenue , Cupertino, California 95014 RESOLUTION NO. 4465 OF THE PLANNING COMNIISSION OF THE CITY OF CUPERTINO RECOMNIENDING APPROVAL OF A USE PERNIIT TO OCCUPY AN EXISTING OFFICE BUII.,DING TO PROVIDE AN ADULT EDUCATION PROGRAM SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as described on Page 1 of this Resolution; and WHEREAS, the applicant has met the burden of proof required to support said application; and ' WHEREAS, the Planning Commission finds that the application meets the following requirements: a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and are not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b) That the property involved is adequate in size and shape to accommodate the proposed use. c) That the proposed use will generate a peak trip rate above the 14.4 peak hour trips assigned to the site. The increase will not change the level of service on the adjoining roadways and is not considered a significant � increase above that which is assigned to the site. � i d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of ' persons residing or working in the neighborhood of such proposed uses, nor injurious to properly and improvements in the neighborhood. � NOW, 'TI-�REFORE, BE IT RESOLVED: � That after careful consideration of maps, facts, e�chibits, testimony and other evidence submitted in this matter, the application for Use Permit is hereby recommended for approval, subject to the conditions which are enumerated in this Resolution beginning on Page 2 thereof; and That the subconclusions upon which the findings and conditions spec�ed in this Resolution are based and � contained in the Public Hearing record concerning Application 2-U-93 as set forth in the Minutes of the Planning ( Commission Meeting of June 28, 1993, and are incorporated by reference though fully set forth herein. ( SECTION II: PROJECT DESCRIPTION � Applicant No(s): 1-U-81 (Mod�ed) � Applicant: University of San Francisco Property Owner: Cupertino Office Park Assoc., LTD Location: 20085 Stevens Creek Boulevard Resolution No. 4465 (1-U-81) June 28, 1993 Page -2- SECTION III: CONDITIONS ADNIINISTERED BY THE COMMUIVITY DEVELOPMENT DEPARTMENT L APPROVED EXHIBITS The recommendation of approval is based on Exhibit labeled Site Plan I Irrigation Plan A-1 dated June 4, 1982, except as may be amended by the Conditions contained in this Resolution. 2. APPROVED USE Approval is granted to conduct a Monday through Saturday higher education facility of 10,000 sq. ft. 3. ENROLLMENT LIMITATION The tenant shall not exceed an enrollment of 145 students. The hours of operation on shall not exceed 10 p.m. Monday through Friday and 6 p.m. on Saturday. 4. RECIPROCAL PARKING The property owner shall enter into a private agreement with the adjoining parcel west for reciprocal parking. The agreement shall run with the land and shall be recorded prior to occupation by the school. 5. INGRESS/EGRESS The property owner shall provide proof of a recorded ingress/egress easement with the adjoining properties east and west. If one does not exist, the property owner is obligated to implement one which shall be recorded prior to occupation. i I 6. HANDICAP The existing handicap spaces shall be upgraded to current code, to the satisfaction of the Building Department. I 7. TRASH ! I The trash bin shall remain in the enclosure at all times. 8. ELEVATOR If exterior building modif'ications are required to install the elevatar, the Architectural and Site Approval Committee shall review and approve said changes. 9. BICYCLE In cooperation with the Congestion Management Agency and Bay Area Air Quality Management District ' goals, one bike rack shall be installed to encourage bicycling to and from the site. The bicycle rack shall be ( located at a staff approved location and installed prior to occupation. 10. SANITARY All Sanitary District fees and other requirements shall be completed and proof provided to the Building _ Department prior to occupation. CENTRAL FIRE Submittal of building and floor plans shall be submitted and approved prior to occupation with plans provided to the Building Department. 12.
