Street widenir�g, in�r� and dedications shall be provided in
avoordanoe with City Starydards arid specifications and as required by
the City II�gineepss. �
Said ing��ovement st�all include malification of the Mariani
Avenue/DeAnza intersection. East app�oach impr� shall be
i�lemented oo��urrently with the f irst pha.se of p�oj ect oonstruction .
Sauth ap�oach imp��c�vements shall be ittq�le2nerited as direc.�ted by the
City. To ensure cxe�letio� of said south approach in�rovements, the
develaper shall pravide a Letter of Credit in the amount of $130,000
valid far� a period of seven years frcem the effective date of the use
permit.
Prior to issuance of buildir�g permits for construction of all or any
portion of the app�aved development, the clevelo�r shall prwide to
the City a Letter or Credit, or other suitable financial instnmient,
as security for widenir�g of the DeAnza Boulevard �idge aver Route
280. �e developer shall contribute $250,000 for said widenirig
inq�rove�nents. In the event that the total project c�.ost exceeds
$500,000, the applicarit shall contribute 50� of the actual oost as
detennir�ed by the official �gineer's Fstimate.

Ctlrbs and gutters, sidewa7ks arid related structures shall be installed
in aooardarioe with grades ar�d star�dards as specif ied by the City
E�gineer.

Street trees shall be planted within the Public Right of Way ar�d shall
be of a type approved by the City in avcardanoe with Ordinanoe 125.

a000rdanoe with Ordir�anoe 1143. First floo� finished floor elevation
shall not exceed the hic�est top of curb elevation on the adjoinirig
DeAnza Baulevard frontage, unless the need for greater elevation i.s
de�monstrated to the City IIlgineer for purposes of achieving proper
site drainage ar resolvir�g other technical oonstraints.

this Resolution. Said deed restriction shall pravide for n�oessary

Said easeznents shall be reoorded at such t�me as interest in one or
more of the affec.-ted paroels is initially sold or transferred to

Z'he Ca�on Area shall have no st�r�d-alone use credits �xan recordation
of the final map.
15. USE PF�T ON AND 'I'�M RFSPONSIBII�ITY
The p�oject OC&R's shall provide that the Praperty Owner's Association
shall be responsible to the City far� carrying vut all conditions to
use penti.t 11�90 ar�d shall asstmne liability far penalties or
sanctions for failure to meet these standards.
Said OC&Rs shall provide for the assigrnnent of entitlements ar�d
► obligations ur�der Use Permit 11-U-90 to all property owners, including
maintenanoe and ocs�m�on area.
Said CC&R's shall specify the City as beneficiary of the CC&Rs.
Said cC&Rs moust be ap�o�ved by the City Attorney prior to recordation.
