acx�trnnodate the proposed use .

That after careful consideration of maps, facts, exhibits, testimony and
other evidence su�iitted in this matter, the application for Use Permit is
hereby reoom�nended for approval, subject to the conditions which are
ernmnexated in this Resolution b�ginning on Page 2 thereof; and
'That the s�bconclusions upon which the findings and conditions specified
in this Resolution are based ar�d conta�ried in the Public Hearitig record

Curbs and gutters, sidewalks and related structures shall be installed
in a000rdance with grades arxi standards as specified by the City
�gineer.
3. SIREET LIGHPING INSI'ALLA'1'ION .
Street lighting shall be installed and shall be as approved by the
City �gineer. Lighting fixtures shall be positioned so as to
preclude glare ar�d other forms of visual interference to adjoining
properties, ar�d shall be no higher than the maxiirnun height permitted
by the zone in which the site is located.
4. FIRE HYDRANI' ,.
Fire hydrants shall be located as required by the City.
5. TRAF'FIC SIQJS
Traffic control signs shall be placed at locations specified by the
City.
6. STREr,r'I' TRE�SS
Street trees shall be planted within the Public Right of Way and shall
be of a type approved by the City in a000rdance with Ordinance 125.
7. GRADING
Grading shall be as approved and required by the City E�gineer in
acoordance with Ordinance 125.

8. DRAINAGE
Drainaqe shall be provided to the satisfaction of the City �gineer.

The developer shall �ly with the requirements of the Underground
Utilities Ordir�v�oe No. 331 and ather related Ordinar�es and
regulations of the City of Cupertino, ar�d shall 000rdinate with
affected utility prwiders for installation of w�dergraurrl utility
devioes. 'The developer shall su�niit detailed plans shcxaing utility
undergr�u�d provisions. Said plans shall be subject to prior appraval
of the affected Utility provider and the City E�zgineer.

10. APPRaVID �BITS �
The reoommendation of appraval is based on F�chibits Plan 5heet 1 and 2
revision 1, dated 9/90, Site Plan, Floor Plan, and Elevation, except
as may be amended by the Conditions oontained in this Re��olution.
11. NK)DIFICATION OF APPROVID DEVELiOPN�'r PLAN ��
In the event that the applicant or subsequent property awnex shall
desire to make any minor changes, alterations or amendment of the
apprwed development plan, a written request or revised develo�xnent
plan shall be su�mitted to the Director of Plar�nirig and Develo�nent.
If the Director makes a finding that the changes are minor ar�d do not
result in a material affect upon the appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning Ccmunission.
If the Director firx]s that the requested changes are material, such
c��ariges shall be referred to the Planning C�nnnission for approval. If
the changes are denied by the Planning Crnrnnission, the applicant may
appeal tc� the City Council as provided in City Ordir�ance No. 652.
If said changes are approved by the Plannirig Cotmnission, an appeal may
be made to. the City Co�uZCil by ariy interested party. �,irther, any
Member of the City Council may request a hearing before the City
- Council regarding :said appraved changes. Said request shall be made
within ten (10) days frorn the date of approval of said changes by the
Planning Ccmnnission.

12. OFF STREEI' PAR���TG '
Ztao (2) functionally indepe�xlent off street parking spaces shall be
pravided on all parcels to c�n..Sate for the lack of public street
parking, The two (2) parking spaces shall be pravided in addition to
two (2) enclosed garage spaces.
13.
Prior to issuance of the kuildirig permit, the applicant shall go
before the Architectural aryd Site A�roval Ccarnnittee. The Co�m�ittee
shall pravide direction and give final appraval of the building
orientation, building materials, arc.hitectural style, and windaw
locations with regard to best location far views to.the yard areas.
Ftirther, the type of building materials and architectural detail
should be varied to Greate divexsification. The building square
footage, floor area ratio, building coverage and relative setbacks may
not be iricreased, but the building envelope can be shifted on-site or
inverted.
