WI�RF,AS, the Planning Co�aunission of the City of Cupertino received an
application for amerx�nent of a Use Permit, as described on Page 2 of this
Resolution; and
Wf�RF,1.�S, the applicant has met the burden of proof required to support
said application.; and
Wf�RF,AS, the Plannirig Conunission finds that the application is
appropriate given adequate doc�mientation of available parking space
according to the Barton-A,schman Report of July 25, 1990.
NOW, �'ORE, BE IT RESOLUID:
That after careful consideration of maps, facts, exhibits, testimony and
other evidence suxanitted in this matter, the application for amendment of
Use Permit is hereby reco�mtended for approval, subject to the conditions
which are ernm�.rated in this Resolution beginning on Page 2 thereof; and
'That the subconclusio�s upon which the fi.ndings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 21-U-86 (Amended) as set forth in the Minutes of
the Planning Carrnnission Meeting of September 10, 1990, and az'e
incorporated by reference as though fully set forth herein.

SEC:TION III: C�ONDITIONS ADNII�TISI'ERID BY THE PUBLIC WORKS DEPI'.
1. GRADING
Grading shall be as apprwed and required by the City E�gineer i.n
accordance with the City's Gradirig Ordinance.
2. DRAINAGE
Drainage shall be provided to the satisfaction of the City E�gineer.

3. APPROVID E�IIBITS
The re�nex�ation of approval is based on �thibit standard detail of
trellis dated 8/90, Site Improvements Schematic Design, Site I�rovements
Design Development dated 8/29/90, except as may be amended 17y the
Conditions contained in this Resolution.
4. BICYCLE PARKING
Prior to final inspec.-tion of the approved trellis structure, the developer
shall install the required rnunber of bicycle lockers stated in condition
No. 16 of Use Permit 21-U-86.
5. LIGH'I'ING
A detail of the proposed trellis lightirig with ltnminaire information shall
be provided to staff for appraval. All lighting encasements must be hidden
within the trellis work and shall be paintecl an obscure color, to be
approved by staff. Additional lighting for athletic courts, with the
exception of the existing parking lot light standards, are not allawed.
8. LANDSCAPING
The final larid.scapirig plan for the fountain shall be forwarded to the
Architectural & Site Approval Co�rnnittee for confirmation of cc�mpatibility
with Xeriscape guidelines. Also with regard to the amount of space given
for the specie to grow, weight of rock & possible future settling in�aact to
tree roots and watering methods for the proposed type of specie.
9. PARKII�iG
Prior to construction of i.�rovements authorized under this Amendm�nt, the
developer shall enter into an agreement with the City of Cupertino
providing for replaceme.nt of parking spaces up to the level required under
City Ordinance, if chronic overflaw parking demand is determined to be
detrimental to surrounding properties and the public street system.
Said Agreeme,nt shall provide for a fact-finding hearing under a future
Planning Connn.ission Age.nda as a New Business item, the result of which
shall determine the nece.ssary level of mitigation, if any.
