City �gineer. Lightir�q fixtures shall be positioa�ed so as to
preclude glare and other fo�zns of visual interferenoe to adjoinir�g
Pr'operties, and shall be no higher tl�.�n the maxiaana h,eight permitted
by the zone in which the site is located.
4. FIRE SF,F'E'I'Y
Developer shall oa�ly with all fire safety require�nents s�ecified by
the City in v�nsultation with the Central Fire District.
5. STREE'r ZREES
Street trees shall be planted within the Public Ric�t of Way and shal.l
be of a type ap�wed by the City in a000rc3anoe with Ordinanoe 125.
6. GRADING
Gradinq shall be as ap�ov�ed and required by the City II�gine�r in
aocoz�lanoe with Ordinat�oe 125. First floo� finistled floo�� elevation
shall not e�ooe�ed 24 irx��es above the highest tap of c�b elevation o�
the adjoinir�g Stelling Road fY�taqe, unless the i�eed fo� greater
elevation is d:�ronst�ated to the City II�gineer far� purposes of

� devioes. The develaper shall sukmit detailed plans st�owing utility
w�dergro�and p�ovisions. Said plans shall be subject to p�ior ap�oval
of the affected Utility p�ovider ar�d the City �gineer.
9 . AGRREE�3�fr
The proj ect developer shall enter into an inq��n�ent agre�t with
` the City of Gvpertino p�rovidir�g for payment of fee.s, ir�cluding but not

equipment enclosures shall be screened with larydscapinq or located

areas. The pro�osed AgaPanthus transformer screenirig plants ir�dicated
on Sheet LS-1 shall be c�anged to a pl.ant screen with denser foliage.

In the event that the applicant ar� subsequent p�apeity owner shall
desire to make a� mir� chariges, alteratica�s o� ame�t of the
ap�p�oved dev+elogn�nt plan, a written request ar revised develapmesYt
plan shall be suhnitted to the Direct�ar of Planniriq ar�d Development.
If the Direc. makes a findir�q that the c�anges are minar� azxi do nat
result in a material affect �z the appearanoe ar functiori of the
P�'o7ect, said changes may be oertified on the revised plan. If
ap�p�oval of said changes is withheld, the applicant may ap�eal to the
Planning Cc�nnission.
If th�e Ditectar find.s that the requested chv�ges are material, such
char�ges shall be referred to the Planning �nnission far app�wal. If
the c3�anges are denied by the Planninq �ission, the applicant may

If said changes are approved by the Planning Danamissiori, an appeal may 1

grooery stores shall be subject to a separate Use Permit apprwal.

All existir�g structures on the site shall be remwed p�iar� to or
concurrently with p�oject oonstnx.�tion. The developer shall asstrme
the responsibility to obtain all required dem�lition permits in i
accordanoe with City Ordinanoes.

constitute the definitive develognent plan far the site's Planned
