WI�2EAS, the Plannir�g CaYrnnission of the City of Cupertino received an
application for a Tentative Subdivision Map, as de_�ribed on Page 2 of
this Resolution; arid
wI�2FAS, the nec�ssary public notices have b�en given as required by the
subdivisiorr� - and Pra�edural Ordinances of the City of Cupextino, and the �-
Planning Co�nnission has held at least one Public Hearing in re�gard to the
application; and
WI�2F.AS, the Planning Ca�nission finds that the application meets the
followirig require.ments:
a) That the proposed subdivision map is oonsistent with the Ci�ty of

'I'hat upon careful consideration of maps, exhibits, facts, test�mony and
other evidence sukanitted in this matter, the ap�plication for Tentative
S�ibdivision Map is hereby reovmnended for approval, subject to the
conditions enwn�xated in this Resolution b�ginning on Page 2 thereof; and

That the subconclusions upon which the findings and conditions specified
in this Resolution are b�ased are contained in the Public Hearir�g Record
concerning Application 8�IM-90, as set forth in the Minutes of the
Planning Ccmunission Nieeting of May 14, 1990, and are incorporated by
reference as though fully set forth herein.

4. TRAFFIC SIGNS
Traffic control signs shall be placed at locations specified by the
City.

Street trees shall be planted within the Public Right of Way and shall
be of a type appraved by the City in a000rdance with Ordinance 125.
6. GRADING
Gradi.ng shall be as approved and required by the City E�gineer in
accordance with Ordinance 125.
7. DRAINAGE
Drainage shall be provided to the satisfaction of the City �gineer.
S�arface flaw across public sidewalks may be allvwed in the R-1, R-2
and R-3 zones unless storm drain facilities are deemed necessary by
the City �gineer.

8. UNDE�G'ftOUND LJI'ILITIFS
'The developer shall vwtiply with the requir�ments of the Underground
Utilities Ordinanc:e No. 331 ar�d other related Ordinarx�es and
regulations of the City of C�pertino, ar�d shall 000rdinate with
affected utility providers for installation of undergro�uxl utility
devices. 'The developer shall submit detailed plans showing utility
underyraund pravisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City IIzginee,r.
9. Il�4P'FtOVII�RIIV'I' AGREFI�'I'
The project develaper shall enter into an i�rrn�ement agreement with
the City of Cvpertino prwiding for payment of fees, including but not
limited to checking ar�d inspec,-tion fees, storm drain fees, park
dedication fees and fees for undergrounding of utilities. Said
agreement shall be executed prior to issuanc� of oonstruction permits.
10 . TF�ANSFO�2MII�.S . - , . _ . _ .
Electrical transformers, telephone vaults and similar above growzd
equipment enclosures shall be screened with fencing and landscaping
or located underground such that said equipm�nt is not visi.ble frc�m
public street areas.
11. DIDICATION OF WATIIt LINFS
The developer shall dedicate to the City all waterlines and
appurtenances installed to City Standard..5 and shall reach an agreement
with San Jose Water Works for water service to the subject
development. The City �gineer's Certificate of Acceptanc.e of
Engineering/S�arveying Coriditions, Travis Whitten to sign.

A bond in the amaunt of $10,000/tree shall be posted to en.sure
protection of the aforementioned trees. The bond shall be posted
prior to site clearanoe or gradir�g, whichever is first.
14. ACCFSS
One curb cut is appro�ved to pravide aocess for the four lots onto
Stelling Road. A deed restriction shall be recorded simutaneously with
the initial sale of lots 1 and 4 precludirig direct aocess to Stelling
Road.
15. DII�IOLITION RDQLTII�II�Fr
All existing structures on the site shall be removed prior to or
concurrently with the first sale of any lot created by the
subdivision. The developer shall asswne the responsibility to obtain
all required d�molition permits in a000rdance with City ordinance.
