W�S, the Planning Co�rnnission of the City of Cupertino has received an
application for a change of zone, as described on Page 2 of this
Resolution; and
WI�2EAS, the neoessary public notices have been given in aocordance with
the Prooedural Ordinanoe of the City of Ct�pertino, and the Planning
Conunission has held one or more Public Hearings on this matter; and
Wf�2F,AS, the applicant has failed to meet the burden of proof required to
support the application, ar�d has not satisfied the following requirements:
1) The proposed change of zone does not encourage the most
appropriate use of land
2) The proposed change of zone does not provide for orderly
' develo�meazt of the city
3) The proposed chaiige of zone is nat advantageous to the property
ar�d improvements in the zoning district and neighUorhood in which
� the subject site is located.

recon�meryds denial of the svbject application for change of zone by the
