Wf�2EA..S, the City Ca�uicil directed, at their meeting of D�ec�x 4, 1990,
that the staff and Plannirig Cc�nnission consider amenc�nent of zoning
impediments to the resale of dwelling units which are legal non-conforming
by virtue of lot area, setbacks ar�d other prescriptive requirements except
permitted or conditional use restrictions; and

WI�E2F,AS, the necessary public notices have been given in aocordance with
� the Prooedural Ordinance of the City of Cupertino, and the Planning
Co�rnnission has held one or more Public Hearirigs on the subject
application; and
' Wf�RFAS, the Planning Cca�unission agrees that the General Plan objectives
of preservirig existing housirig stocac and assuring the continued
availability of a range of hoiasing choice by tenure type is of vital
interest to the cx�mm�uzity.

That after careful consideration of facts, e�ibits, testimony and other
evide.rx:e sulsnitted in this matter, the Cannnission makes the follawing
, findirigs:
1) The proposed execption clause to allow replacement of legal
non-conforming dwelling units in conventional residential zones
( destroyed by inwluntary action, crn�lies substantially with direction
given by the City Cauncil on Decexnber 4, 1990.
2) The proposed execption clause will be added to each respective
coriventional residential 2one as described in �ibit attached hereto
and made part thereof.
BE IT FUKI� RESOLUED:
That the subconclusions upon which the findings and conditions specified
in this Re��olution are based upon are oontained in the Public Hearirig
reoord conoerning Application 81,004.211 as set forth in the Minutes of
the Planning Cc�nunission meeting of April 9, 1990, and are incorporated by
refere,zx;e as though fully set forth herein.
