OF THE PLANNINU COMMISSION OF THE CITY OF CUPERTINO
REC0�IENDING the approval of a use permit to allow
a modification of height far a transmitting/receiving
antenna from fifty-five (55) feet to ninety (90) feet
as provided in Secti.on 6�.6 of Ordinance 220(g).

CONDITTONS AND FURTHER FINDINGS:
1. The application is approved based upon Exhib�ts A& B of Application
17-U-73.
2. That the approval is recommended for a temporary period of three years
from date of approval upon which time the application shall be reviewed
by the Planning Commission,
3. That the application sha11 be revie�•Jed by the Planning Commission in the
event the residents in neighboring adjacent homes complain of electronic
interf erenca from the antenna installation.
4. The applicant shall apply for building permi� approval prior to installa-
� tion of the antenna.
5. The tower shall be located a minimum distance of 100 feet from the
southerly property line and that the maximum height of the tower shall
be 90 "feet.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT �
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said ap�lication; and ,.
.
WHEREAS, the Planning Commission f inds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
• on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.
