CONDITIONS AND FLRTHER rINDINGS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a confli.ct does
exist, the special conditions as enumerated herein shall apply.
15. The application is approved subject to the site plan, labelled
Exhibit A, 9-U-73, lst Revision.
16. The existing twenty-four hour ambient noise level measured at
the common property line between the Intersil site and the
Westwood Oaks Subdivisicn sha11 re�r�ain at the existing level
as identified by an acoustical engineer. The maximum tolerable
decibel range for the nitrogen gas generating plant and associated
pumping measured at the com�on boundary line between the Intersil -
� site and the Westwood Oaks Subdivision after expansion of the
off-street parking lot shall not exceed a range of 51 decibels to
53 decibels.
17. The Intersil Corporation shall expand the total number of off-
• street parking spaces for the entire site by a number to offset
the number of spaces remove� by the nitrogen gas plant.
18. Truck deliveries involving the transferring of liquid nitrogen
shall be limited to tl�e hours of 8:00 a.m. to 8:00 p.m.
19. Should the City develop a more restrictive sound level than 51-53 DBA
at any time in the future, the applicant shall be required to comply
with any such regulations.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT �
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHBREAS, the Planning Commission f inds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of progerty, '
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires, ,
� e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and

BE IT FURTHER RESULVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties aff ected by
� this decision. �
