There was a request to hear item 3(17-U-73) prior to item l, which
will continue to 10:00 P.M. The Deputy City Attorney said anyone
, getting a copy of this agenda, which indicates the General Plan will
continue to 10:00 P.M., might not appear at this meeting until 10:00 P.M.
to speak to application 17-U-73. Therefore, he advised against taking
any items out of order.
Upon the advice of the Deputy City Attorney, it was the general
consensus to proceed with the m�eting according to the agenda.
� PUBLIC HEARINGS
l. CITY OF CUPERTINO: Public Hearing to consider 1973 Comprehensive
General Plan. First Hearing continued.
NOTE: The above public hearing regarding the General Plan will
end for this meeting at 10:00 P.M. .
The Planning Director reviewed the October 8, 1973 staff inemo on "General
Plan Program - Park Land Needs Relative to the Land Use Element". He
said that although the charts are hel.pful, the Ylanning Commission
decided it was necessary to go through each neighborhood to determine
whe*_her or not the City's goals are bein� attained. Seven Springs
Ranch and the Church progerty will take care of their own park needs,
but it will be necessary to discuss the other properties.
� The Planning Director reviewed the map showing the existing parks within
Cupertino. Comm. Nellis was concerned about the Eaton Sr.hool area being
in need of some sort of neighborhood park facility. Another area is
. the Garden Gate area that is presently in the County, alChough the
rieMOrial Park and possible Saich property purchase will help alleviate
this problem. The third area of concern was the east/west side of
Highway Nine.
Vice-Chairman 0'Keefe noted that quite often the school sites have school
programs going and are not always available for park purposes to the
. citizens of Cupertino. The Director of Parks and Recreation explained the
parks usage by children and adults. After school, we average 25 to 50
children on the playgrounds. We have 20-40 adult classes.
Comm. Gatto asked �rhere the greatest need is in regard to park development
or programs. The Director said green areas and tennis courts are in big
demand. The Farks Department is trying to coordinate the school needs
with the neighbonc��ad park needs.

The Parks Director said the big need no� is to develop those
park sites that we already have. The Parks Commission is also
considering an addition to th.e Memorial Park.
The Parks Director suggested the Planning C�mmission consider
those areas used by the Little League. There appears to be gro�vin
interest in this sport.
Vice-Chairman 0`Keefe stressed that there is also the need for ,
areas for unorganized play.
Comm. Nellis said she �aould like some time to digest the lengthy
memo given the Commissioners at this meeting and she would also
like to hav� a full Commission present w�en the decision is made.
The other Commissioners agreed with this point. They would like
to continue this d�scussion but defer any conclusions.
Vice-Chairman 0'Keefe asked about the locatioz of historical sites
The Parks Director said there has been talk recently about it
costing up to $35,000 to fix up the Parrish House. The location
has not been decided upon. It is generally felt that it should be
moved from its present location. There is the ever-present danber
of fire; also, the roof is starting to buckle. Tha Planning
. Director said there has been some discussion about creating an
"Old Town" area where these structures of historical value, such
as the Parrish House and Trianon can be p]_aced. Vice-Chairman
0'Keefe noted there are several things of historical si�nificance
in the Cupertino area and we must be careful that we don't lose
them, as we already have lost several.
Rancho P.inconada was discussed next. The Parks Director said the
private recreation area ttiere is used and paid for by the resident .
There are three school sites in that area that serve the community
It was noted there is no land available for parks in that area at
the present time. There are 4800 people in that area.
Conclusion: It will be necessary to look at the school sites
westerly of Miller Avenue to serve the park needs of that area.
It has been f elt previously that Wilson School and park would
pretty much take care of the park needs in that area.
Vice-Chairman 0'Keefe stated that both Mountain View and Sunnyvale
have learned that it does not work to have a park across the stree
from a high school with open campus.

The Planning Director said there is the question of whether Memorial Park
will fill the park needs of t�e areas west of Blaney, around Eaton School,
Che Town Center, Faria School, and northerl� to the Garden Gate area.
. Comm. Nellis said that if we go re.sidential on the eaat side of Highway
Nine north af 5tevens Creek Blvd., there will be a need for park property
in that vicinity. There would also be a need for one on the caest side,
regardless of whether or not we add more residential in rhat area.
There is a 5-acre site on Valley Green Drive for that purpose.
It was noted there will be access to Memorial Park from various
neighborhoods. The City Council has discussed the possibility of access
of the Saich and Christianson property for extension of Memorial Park.
There are approximately 1000 units between Stelling and Highway 85, �
some with their own recreation areas such as the Avery development.
Comm. Nelli.s is of the opinion that Memorial Park can serve r.eighborhood '
as well as community par_k needs in that area.
[aest of �re�way 85, the Somerset Park has had good response. •
In the Mann Drive - Oak Dell Ranch area, the Parks Directer said t.hat
the people would like to have a park in their area. The people grefer
not to have the access to Stevens Creek Park improved because of the
inYierent problems. The Horse Ranch is also in that area.
• Depeiiding on what happens �aith Stevens Creek Blvd., there is the
possibiiity of some long, narrow areas tor passive-type recreation.
The Parks Director said that a year ago, San Jose Recreatian Department
clropped the recreation program at Kennedy Junior High SchoUl, so the
Cupertino Recreation Department picked it up.
Comm. Gatto said the school f acilities that function as park recreation
use should be counted. WherPVer there is vacar�t land adjacent to the
school sites, the City should make every effort to acquire that for park
1and. We should go after those lands now. The otily area where we are
deficient is between Highway 9 and Stelling. Conun. Nellis agreed that
we should be I�oking for a site �,rest of Highway 9 and, depending on the
City Council's thoughts on the High�•aay 9 praperty, we m�y also need to �
look for another site on t-he east side of Highway 9.
Vice-Chairman 0'Keefe said �re have a school district that serves several
cities.

The Parks Director said �e have 16 or 17 community programs going
at Cupertino High School., including adult education, tennis courts
basehall.
It was brought out that the big factor in deciding the community
use of the school plant depends upon the administrator. •
Vice-Chairman 0'Keefe said he sees the need for a policy and some
type of long term agreement if the schools are to be used for
community recreation needs. As the western part of Cupertino
develops there wil? be increasing need for use of the Monta Vista
High School facilities. We are using De Anza tennis courts.
The Planning Director said that if there is a need for another
community park, there is an area along Honey Creek that is of
historical value. Perhaps the Parrish House, Trianon, etc., could
go Chere. �
Comm. Nellis said she is hoping the General Plan will indicate
what and where we have things that are of historical value.
Vice-Chairman 0'Keefe said the big thing to consider with these
historical structures is vandalism.
Comm. Nellis would like, at some time, to have a report given as
to the matters of historical value in the Cupertino area.
With the Horse Ranch and the golf course, Com*n. Nellis said we
are in pretty good shape with parks on the �aest side.
Vice-Chairman 0`Keefe asked for comments from the audience.
Mrs. Lucien Hertert,�San Juan Road, suggested the Historical
Society compile a list of historical buildings and sites that
should be preserved. Since Dr. Hart is no longer with the school
district, she wondered if it taould be a good idea for the City to
get together with the School District and reaffirm the agreement.
Mrs. Hertert brought up the fact that sometimes the school grounds
are fenced and locked after schaol hours. At the present time,
the Principals of the schools have the choice to lock up the
school if he sees a need for it.
Mrs. Hertert said she looks for playground eqiiipment and drinking
fountains for little children, and perhaps benches for older perso s
to sit on to rest and admire the scenery. There is no place
during the day for senior citizens, adults or little children to g.

If not tennis courts Hertert �ould like to see at least backboards
for play. She asked abottt the possibility of the City purchasing 2 or 3
lots within neighborhaods for park purposes. Probably all that would
be needed woulc� be trees, l�enches and drinking fountains. This would be
a place the people cou.ld wallc to, in the Monta Vista area in particular.
� She spoke ta the need far a variety of recreational opportunities.
She said Mr. Walter Osterman, of Kaiser Cement, orally agreed to Scout
camping or family camp�ng areas being developQd on Kaiser property.

3. Application 17-�T-73 of GTILL W. LESTER: Use Permit to ,allow a
modification of height for a transmittingireceiving antenna from
fifty-five (551 feet to ninety (90) feet as provided in Section 69.6
of Ordinance 220(g). Said property is located at 10650 Linnet Lane
in a P(Planned Development) zone. First Hearing.
The Associate planner said that in 1967 Vallco Park was granted a Use
Permit to construct a 90� high antenna in the southeast quadrant of
Pruneridge and Wolfe Road, which is now the Hilton Hotel site. The
proposal is to relacate this to�,rer at the rear of the Lester home, and °
about 175' from the closes� neighboring structure.
i�1r. Will Lester , 10650 Linnet Lane, said they 3o have a to�aer that has
been in operation since they came into the City. It is VHI' and do2s
not interfere with radio or. TV reception unless they are equipped with
VHF. Mr. Lester said he uses this radio in conjur.ctian with his mobile
units t� conduct his business, in regard to the ranch operation and
security of Vallco Park.

Comm. Gatto asked about the guy wire base distance.� Mr. Lester
said it is not really necessary to have them, but the Building
Department requires three sets of guy wires at 60 angle. These
will all fall within his property line.
Mr. Lester ans�sered Comm. Adams that he has never received any
coniplaints about TV reception in the area. Comm. Adams said he
would go along with this proposal as lozig as one face of the
tower is not perpendicular to the TV transmission. Mr. Lester
said he does not anticipate any problems. Comm. Adams noted that
this request is only for a 3 year time period.
The Deputy City Attorney said there is the procedure to make a
complaint with the FCC �sh.en and if a problem arises . rtr . Lester
agreed, and added that the FCC restrictions are quite stringent.
Comm. Gatto asked how th�s site was chosen over some other site
on the Vallco Park property. Mr. Lester said that at the present
time, he has one monitor at his home and another at the Lester &
Lester Office. Now they want to reverse it.
Vice-Chairman 0'Keefe asked for comments from the audience.
Mr. Warren F. Mink, 10630 Becker Lane, spoke on behalf of his
Father, who lives next dcor to Mr. Lester. He said they get alon�
fine, but although the tower presents no problem, the guy wires
do. As to complaints in the neighborhood, perhaps none have been
made because the people did not know where the problem originated.
The Deputy City Attorney said a phone call to the FCC is enough
to initiate a check.
Mr. Mink said he would prefer that the tower were located on an
alternate site. There is the possibility that if the tower should
fall it could fall on his Father's drivewaq with the possibility .
of damaging cars and/or injuring people.
Mr. Lester presented another exhibit. He said there is no way,
if this tower were to fall, for it to fall anywhere but on his
own property. His neighbor`s garage is 125' from the to�er.
