1. CITY OF CliPERTINO: Public Hearing to consider 1973
Comprehensive General Plan.
Mr. Arnold suggested the Planning Commission work on four objec-
` tives at this meeting:
1) A state�ient of basic goals.
2) ReassessMent of "other commercial:'
West of Highway 9. �
North of Stevens Creek Blvd.
3) Residenti�l versus low density industrial on Highway 9.
4) Poli.cy statements.

Mr. Arnold summarized that first the Planning Comrnission developed a
concept that we want to make Vallco Park the sole regional node in the
City of Cupertino; that it �sill be �d�quate for development of our
regional activities. Secondly, the CommiSsion has developed a strong
statement that it thinks the Town Center at Highway 9 and Stevens
Creek Blvd. is an area that will have activities that are town oriented;
that will service the citizens of Cupertino primarily. The Commission
further found there should be some distinct break bet�,reen the Regional
Center and the Town Center. There wi11 be low densi.ty development along
Highway 9. The fifth consideration that ties in with the balanced
community idea is that the Commission �ould like to have a fiscal
balance. The sixth element is that the Commission is attempting
to get some identity for the City of Cupertino. t+le are developing the
concept of a tree-lined boulevard with perhaps a 30' setback along
Stevens Creek Blvd. and along Highway 9. The bike lanes and pedestrian
Craffic can. be tied into this.
Mr. Levy told the Commission that they must remember �ae already have
a great deal in the City: Vallco Park, De Anza College, and now a Town
Center. He said the minute �ae find c�re want loca density in an area we
think of resi_dential. He asked the Cor.tmission to now consider alternate
low intensity uses.
Mr. Levy next �aanted to review the general reasons for the overall '
anal.ysis of commercial. The question has come up a�a�n �ohether there
is some kind of low intensity commercial or industrial. use where the
Planning Commission has put residential. The Plannin� Commission made
the decision on Stevens Creek Blvd., the Totan Center, additional
agglomerated commercial and in-fill. In add-tion to the Regional
Center, the existing commercial without Sears and the in-fill, the
determination was made that the City of Cugertino could handle another
500,000 sq. ft. of agglomerated commercial.
Comm. Gatto asked if 500,000 sq, ft. is a good figure, how much of that •
is satisfied by in-fill. I�?r. Arnold said it �aas bet�aeen 20 and 40%.
Mr. Levy next went through the exercise on how he had reviewed the
de.cisions on the Town Center, the [�Test side of Highway 9, and the Stevens
Creek Blvd, situation. The major criteria positive about the To�an
Center was that the majority of the Planninb Comrlission saw it as
the kind of development they want and as a change to get a diffeLent
k�nd of function from tne Regional. Center, fie then summarized the
ar.alysis in that the fiscal and traLfic inputs did not ��ve too much
• emphasis but thare were positiv�s �n the c�:aracter of th� City,
neighborhood impacts and variety and flexibility.

Mr. Levy noted that it c,ras never realiy considered tirhether or not
we want the other 250,OQ0 sq, ft. of comr.iercial, but rather ��*here
we should locate it.
Comm. Gatto said he �eighed very heavily the thought to have «
commercial activity di.fferent from the Tecan Center and Regional
Shopping Center type, on the west side of High.Jay 9. Mr. Levy
sa�_d �ae rea?_ly did not loolc at ttie traffic in terms of :tihether or
not it would he wortl� the additional lane or lane-and-a-half.
The statement has been made that Cupertino has the best shopping
opportunity in tlie Valley no�a.
The tas'� a� this meeting is to go over the Town Center a.nd to
� go over the decision to see if we really get a p�sitive by having
the second agglomeration. Given the goals, it will be ver.y c�iff-
cult to see that we need that second agglomeration. It :oas felt
t�at we would like to see Stevens Creek ?31vd. with very low
intensity, perhaps residential. Ho�aever, there are a number of
commercial activities already taking place tnere. The Tr�.ffic
Consultant has said that if you have str�_p comr^ercial along
Stevens Creek Blvd. it generates more traffic than a re�ion�l
shopping center. The north side of Stevens Creek Blvd., developed
as commercial, shows no positives as to neighborhood i;*.�pacts.
Chairman Buthenuth �rras not present TJahen the Town Center was
decided upon anci he wanted to know ho�•� the Planning Commission
arrived at this decisi.on. Mr. Arnold said it is a mixture cf
cammercial and residential.
Comm. Nel.lis said the Tocan Center should be an area where a
community can be drawn together. We now have a city hall, pro-
fessional office center and a library. Her em�hasis has been all
along to have the Town Center as community oriented.
Comm. 0'Keefe said it is very important to have a place w�ere the
young people and the people of all. ages can mix. This is an
� opportunity to integrate some of our services. j1e would have a
place with an intensit� over a great number of hours. He sees
ttie Town Center as entirely different from the Regional Center.
It has so:ae tie caith De Anza College.
Comm. Gatto said the To�an needs a community center where the
populace can meet.
Comm. Adams said the strip of Stevens Creek Blvd, between De Anza
and Highway 9, he sees as one end of the focus. He envisions a
theater, high fashion sl:ops, etc. We have already started this,
with the City Hall., Library and Professional Offices. Tt could be
a movie theater or an open a�r amThitheater. Perhaps�tnere could
be so:�e provision for band concerts in the community center. He
does not see this To��n Cer.ter commercial as competing with that in

the regional sh.opping center.
Comrn. Nellis hel�eves there sh.ould t�e a very tight limitation as to
the development of the To�an Center.. It �,ze just put this in PD Commercial

It was felt that some of the types of uses in the Town Center should
be a movie theater, restaurants (perhaps siMilar te Ports 0'Call in
Southern Californiaj, and shops similar to those in Old Town in Los
Gatos and Allied Arts in rienlo Park.
Comm. O�Keefe said the time spent there i,rould be a little longer than
would be spent in a regional shopping center. There would be value in
the variety of offerings and variety of people there. It would be
half shopping and half social. There u�ight be smaller shops for people
with imagination and specialties.
Town Center It �aas the concensus of the Planning Commission to retain their original
deci.sion to decision on the Town Center.

D?scussion next turned to tne area west of Iiigh�aay 9.
Comm. Nellis said that after looking at the fi?ures again, especially
the �n-fill figures f or commercial, and the stateTent made by Mr. Arnold
that the 500,000 sq, ft. of agglomerated subre,ional �aas optimistic,
she believes it is important for th2 Commission to talce another look
at the amount of comrlercial and in-fill. She cannot go alo�g with any
more agglomerated commercial other than the To��rn Center. She �aould opt
for 250,000 sq. ft. of commercial and for it to be located in the
Town Center. Comm. 0'I�eefe agreed.
Comm. Adams went over the figures �ti'e now have approximately 1.25 million
square feet of commercial for the City of Cupertino, t�e expect the City '
to double in size in the next 10 years. If you use the same ratio of
commercial to populaticn, cae could then have 2,5 mi�lion square feet of
commercial. But considering the over�311 picture, he caould even be in
favor of cutting down the amount oE cor.unercial belo�a the 250,000 sq. £t.
agglomerated subregional plus the regional. He does rot think it is
wise to consider any r.�ore commercial on the �-�est side of Hi�hway 9. �ia
also feels the 250,000 sq. ft. existing on Stevens Creek Blvd., from
Highway 9 to Tantau should he reduced. This could easily go residential,
Some of that commercial is quite old.

Comm. Gatto wanted to revie��t the figures: If you take the existin
commercial without Sears and double it ycu have 1,800,000 sq. it.
Add to it the Town Center at 300,000 and in-fill at 400,000.
It still leaves 175,000 sq. ft. of �+rhat the cor�anunity might need.
At this time, Gomm. Gatto believes that to close of_i the gossibili y
of future com�.ercial would be somecanat shortsigY:r�ed. There should
be some additiona.l_ area chosen for other commercial uses, Within
that space there mi�c:t be some quasi pub�ic or prefessionai sses
Co fill in that commercial, He would like to see retention of
250,000 sq. ft. for cc� uses beyond the To;an Center.
Chairman Buthenuth agreed . r�e said i.t will, be 10 or 15 years
at least befare this is all developed. ide should have some
reserve. If the Gommission wants to reduce commercial, tae should
reduce all the agglomerated areas. He noted that Mariani has had
comrsercial zoiiing for 20 years and has not yet developed.
Comm. Nellis, in regard to Comm. Gatto�s thoughts, said that to
keep some conm�ercial perhaps for professional use is questionable
because �1r. Arnold has questioned whether ::�e wiil be able to fi.11
the presently planned professional offices. Quasi public uses
should be placed in residential. As to types of commercial,
Comm. Nellis finds it very difficult to believe that if our goal
is to try to keep our populati.on down to 50;000, if ��ou add the
regional center , t�ie town center and in--f ill strip commercial ,
she can't believe there will be a diversity of commercial availabl .
She does not ��rant this City to end up with a"jti'hite Front" or a
"Rhodesway". She feel_s we should takE a more consezvative
approa.ch to keep our commercial healthy. If cae provide too much
space for coml it will lessen our chances for upgrading of
the present commercial.
Comm. Gatto said rhat ene reason for rehabilitation is competition

said he does not believe this holds tzue in the case of a regional
center.

Vista to Portal, along Stevens Creek Blvd., was discussed next.
Comm. 0'Keefe believes this area on the south side of Stevens Creek Blvd.
in the long run would best serve the City as re�idenL With resi-
dential along bath sides, it would be distinctly different in character
from the regional center at Va11co Park and the To�an Center. We now
have a car lot and a lumber yard there that would best serve nur City
in another location. Comm. Adams concurred. With the type of Town
Center and Regional Center he envisions, depending on the market, he
believes this could be developed residential within twenty years. ,
Comm. Nellis, in re-examining the situation, believes it would be a
mistake to �extend the commercial in this area. She wrould be in favor
of reversing the previous motion that was made.
Chairman Buthenuth feels there is room in this City for other uses.
He questioned whether it was �easible to put residential along
Stevens Creek Blvd. in this area.
' Comm. Nellis believes the 329,000 sq, ft. of in-fill can provide the
space for those commercial uses that do not fit into agglomerated or
regional centers.
� Comm. Gatto said the type of uses that exist are not an asset ta the
City and that type of use should not be fostered or expanded. He
agrees wiCh residential use as a long-term program here. Implementation
may be a problem. The c�irection to go should be a way to eliminate the
existing commercia� between Vista and Portal.
Comm. Adams suggested a Planned Development along here.
Vice-Chairman 0'Keefe observed thare was a car wash and marine sales
proposed on Vista Drive and Stevens Creek Boulevard and are examples of
in-f i11.

It could lend itself well to the uses to the south and west atid

Mr. Arnold asked �thy the northwest corner of Stevens Creek Bl.vd.
and High�vay 9 could not be considered an oper. green area sirni_laY
to the plan for the northeast corner of that same intersection.
T:�ere is presently a service station on that corner and some
vacant land. It would really open up that corner.
After further discussion, it was moved by Comm. Gatto, sec�nd;�d SCB to P.l�;es
by Comm. 0'Keefe that the property bounded on the south by Stevens ��� to Bandl�y
Creek Bivd., on the north by Al.ves Drive, on the east by 'rlighway 9 is cornmercial
and on the west by Bandley Drive, including Parcel E, b� li_sted on
the General Plan Land Use Map as com.mercial.

Chairman Buthenuth asked if there �rere any other commercial areas in
the core area to l�e discussed a.t th.is time. The Planning Director said
the area adjacent to the library site continuing to Yacifica, on the
east side of Torre Avenue could he discussed.
� Comm. Nellis said that in vie�a of the decisions just made on Stevens
Creek Blvd. on the north, she �rondered if the area next to the Town
Center to Blaney Avenue should be reviewed or whetYier the Commission
still considere�l this an in-fill situation bet�see.n the Customhouse
and the Adobe Inn. It ��tas a concensus of opinion of the Commissioners t
that this was an in-fill situation.
The Planning Director asked if it was the Commissioners' feeling that
planned professional off ices should also provide for b anks, coffee
s'tzops, travel agencies, Urokerage houses, and the like. The Commission
felt these were compatible uses. It could be discussed in depth at a
later date.
Residential_ versus Low Intensity Industrial on Hig,h.way 9.
?�Ir. Levy asked how rnuch industrial wo�_lld create the same traffic as
10 dwelling units per acre for tne entire parc�l of 75 acres on the
west side ot Highway 9 and the 67 acres oF TZari_ani property. He said
the T�:affic Censultant had �aorked with the following traffi.c generation
scheme: 40 trips - regional cenCer
25 trips = industrial
7 trips - 10 dwelli_ng units per acre
3 trips = 4 dwelling units per acre.
60 employees per acre
1.2 employees per car
50 cars
He said they would assume half. the cars leave at the peak hour.
Chairman Buthenuth thinks that in this area you �oould have to strip the
industrial a1on� Highway 9 because if you cluster it you would change
the character of the neighborhood. He would like to see this area
stay residential.
Comm. Gatto said that in order Lo «t 72 acres indu5trial you would have
to justify goin� to 8 lanes on Hig►.iway 9. He was in favor. of staying

It was the ganeral concensus of this Planning Commission to con- '
tinue with residential on Hightaay 9. Comm. rlellis ����uld like to �
assign the same number of dwelling units to both sides of Highway i
9.
Comm. Adams was in favor of 4 to 7.6 dwelling units per acre from
Stevens Creek Flvd. to A1.ves Drive and from Bandley A.venue to
High�,ray 9, and 4 dwelling llilj.�5 per acre the rest of the t�ray north �
to I-280.
C�mm. Nellis said she was considering two PD's on the east and on
the west, to try to get the landawr�ers together.
On Highway 9, Com.m. Gatto noted rhe parcels are relatively lar�e
and could stand a r.�ix of densities. The variety would be better
�han to have a homogenious development here. It would bring a �
number of the populatian closer to the Town Center. He w�uld look
at 4 ta 12 units here, as in the Town Center. �
Comm. Adams feels there should be 4 units to the acre near the �
school. He would consider al.lowing a higher density up near the
freeway.
Chairman Buthenuth does not believe 4 dwelling units per acre have
to be by the school.
Comm. GaCto suggested opening the range and let the developer come
in with plans for review. Couun. Ne113s agreed with Comm. Gai:to's
comments about variety.
; Comm. Aclams believes that when you a11ow a ra.nge of density that
we will see the developer come in with the h�.ghest possible:number
of dwelling units. Mr. Arnold said the range could be decided now
and later on a percentage coul.d be set within the range.
Chairman Buthenuth called a recess at 10:00 P.M. The meeting

Attorney Terry answered Mr. Arnold that there have been ordinances
where they have allQ�ed a range of density c�ith a certain percentage
within the range.
Comm. Gatto said the larger the range the more flexibility is allowed
for the total development.

The Assistant Ci.ty Attorney said you set the range, but how you
implement the range can be handled at a laYer date.
Town Center.
Mr. Howard Ruth, 3r., Los Altos said he owns the property on the
south side of Pacifi.ca and part cf the development at the corner
of Pacifi.ca and Torre Avenue. He submitted a letter that reJated
to this. He said he was on� of the original owners �ahen this
property �aas first master planned as Town Center. Iie took part
in arranging to have the CiLy Hall site Lhere. He has always felt
that the Town Center core was from High�aay 9 to the creek and from
Stevens Creek B]_vd. to Pacif.ica. His concern i_s the fact that he
was told by the staff there has beeri some prel.iminary recommer�dati'n
• for lo;v density residential on the south side of Pacifica. �Ie
feels this would be somethi_ng that �aould not be in the best intere t
of the development of the property as to being compatible with
what he has always thought of as the cor.e area. If his property i
designated loca density resi.dential, tllen he would consider his ,
property was not a parC of the Town Center any more. He askedt-hat
he be alloised i�o retain his conunercial zone for professional offic
use. He envisions a quality development there, similar to ��rhat is
already in that area.
