Reso 1126 81,003 RESOLUTION N0. 1126 OF THE PLANNING COMMISSION UF THE CITY OF CUPERTINO RECO�L'�iENDING THE RESCISSION 0�' PLANNING CCtiL�ISSION RESOLUTION N0. 1125 relative to the amendment of the 1964 General Plan. The recommendation to rescind Resolution No. 1125 is in response to recent �tate Legis].ation, specifically Senate Bill 1239, �ahich decreases the urgency of making zoning consistent with General Plans. The Corn«<ission further recommends that in order to further the orderly development of the pending General Plan revision, that an interim study zor.e be imposed on specific commercially-zoned properties described on the map labeled "Fxhibit A, Interin Zoning ylap for Commercial Property", dated Decer�ber 7, 1972 for a period of four (4) months. The reasons for the interim zoning are those set forth as follows: The Planning Commission is engaged in a comprehensive study of the General Plan, including but not limited to consideration of the Land Use anc'i Circulation elements. • Substantial doubt exists as to the conformity of existing commercially- zoned property to the presently adopted General Plan, State�.Law requires that the zoning ordinances shall be consistent with the General Plan by July 1, 1973. Proposals have been submitted to the City for development of commercially- zoned property that do not appear to be in conformance with the existing General Plan. � � Continued development in presently zoned comr:iercial areas prior to adoption of a revised comprehensi�ae General Plan could result in inappropriate land uses adversely affecting Che natural resources of the community, traffic safety and circulation requirements of the community, the community needs for public services and utilities, and could create an environment adverse to the health, safety, and welfare of the community and its citizens. The commercially-zoned areas herein being pl�ced under interim zoning regulations are more particularly described in ExhibiC "A" attached hereto and made a part hereof as fully as if set forth at length herein. The Planning Commission of the City of Cupertino f.inds that in order to prevent premature developr�ent it is in the best interest of the public health, safety, and �aelfare to impose interim zoning restrictions on development durin� the period of study so as to adequately complete said study, analyze the results thereof, and to put into effect the conclusions of such study. . ^l�
