CONDITIONS AND FURTHER FINDIIv'GS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a contlict does
exist, the special conditions as enumerated herein shall apply.
15. Uutdoor display of mPrchandise, relative to the car wash and
gasoline dispensing facility, such as tire racks, v�nding machines,
etc. shall not be permi�tted.
16. The granting of this approval. is condit�onal upon the contir.ual
upkeep and rnaintenance of the landscaped areas.
17. Tt�e applicant will install an internally illuminated message sign
at the Pntrances tc �he car wash facility that wiJ_1 be aucomatical2y
actuated by vehicle detectors so that if a vehicle is present at the
detector for a certain period of time, a suitable m�ssage will be
, displayed indicating *_hat the facility �s cl_osed or occupied to its
capacity. The message on this sign and the length of occupancy time
of the vehicle at thz detector will be determined by the City Traffic
Engineer.
18. If it is found that, even wiCh the provisior.s stated above, traffic
backs onto Sarat�ga-Sunnyval.e Road as a result of operaticn of the _
car wash facility, the sit� plan will be revised 3nd the entrance �
an Saratoga-Sunnyvale Road will be recc+nstructed and closed.
1�. The City will reserve the right to review the use �ermit if at any ,
ti.me the traffic circulation around this devPlopment-becomes a
prablem due to the characteristics of its operation.
20. The applicant shalY landscape the Saratoga-Sunnyvale frontage of
the site in a manner which will screen the east opening of the car
wash buil�ing from passing motorisLS on Saratoga-Sunnyvale Road.
21. The car wa:;h operation shall comply with t�ie noise emissic�n
standards as contained in Appendix A of ��dir�ance 22Q{k). The�
decibel levels listed under the column "at lot boundary" shall �
apply.

RESOLUTION 0� THE PLANNING COMMISSIO� OF THE GITY OF CUPERTINO GR.ANTING
A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application far a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
� following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property.
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, �afety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the.property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibi.ts and other
evidence submitted in this matter, the application of the USE PERMIT be,
and the same i5 hereby granted, subject to the conditions stated on
Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is her�by directed to nctify tha parties affected by
this deci.sion.
