OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMNNfENDING THE GRANTING OF A ZONE CHANGE from Agricultural-
Residential (Al-�+3) to General Commercial (Cg-rb).

1-12 Standard Conditions (listed on Page 1)e
13 Lot area within fifty five (55) feet f'rom the center
line of Homestead Road shall be landscaped or other-
wise reserved in such a way that it does not present
an obstacle to a possible future widening of Homestead
Road to 110 feet.
14 There shall be only one entrance from and one exit to
Homestead Road, in locations and with standards approved
by i�he Director of Public Works; except that another
ent;rance or exit may be approved through a Use Permit
p.rocedure, if a Use Permit were granted for an auto-
mobile service station on the corner lot. It is under-
stood that if a median divider is constructed in Home-
stead Road there will be no break in front of subject
property.
15 In case no development has taken place on subject pro-
perty within twenty four (2�) months from the granting
of this rezoning, the City may initiate rezoning pro-
cedures upon proper notice.
16 The designation of the zone shall be CG-rb, and it shall
be so indicated on the Zoning Map. Ordinance 220(f) of
the City of Cupertino shall be amended by adding:
"rb = Al1 conditions and findings in Resolution No. 386
of the Planning Commission of the City of Cupertino
shall apply."

MENDING THF GRANTING OF A'LONE CHANGE.
U1HER�AS, the attached application has been su.bmitted to the Ci�y of
Cupertino reqtzPsting a change of zone in the zoning regulations of
the City, as stated on Page two; and
WHEREAS, the Planning Commission has held at least one public hear3ng in
regard to the application on the date as noted on said application; and
WHERFAS, the Plannin� Commission has duly considered and r.eard all
evidence stzbmitted in regard to said application; and
1r1HEREAS, the necessary public notices have been given as recluired by
the Zoning Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
1. That the Planning Commission finds that the proposed zone change:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provid2s for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Prom�tes the health, safety and publ3.c welfare,
f. Provides for th� orderly development of the City,
g, Is advantageous to the prop�rty and irnprovement; in the zon3.ng
district an� r�eighborhood in which the propert�T is located.
2. That said Plannzng Commission, i,herefore, reports fa�rorably to
the City Council in the matter of granting said zone change.
Said approval to be sub�e��t to the following conditions:
Exhibit "B", which is composed of Conditions 1-12 quoted below:
1. Install ornamental street lights. All lighting sna11 be designed
to in no way interfere with adjacent residential d.is'crict.
2. Street trees will be planted in the public right-of-way and shall
be of a type approved by the City in places designated by tr.e Cit�r.
3, Tl�affic control signs will be placed at 3ocations to be specif'ied
by the City.
�. F�.re hydrants shall be located as requested by the City,
5. A ma�onry wall will be built separating any commercial area from
any residential are�.; which wall shall be six fEet high above the
highest ad�joining finished grade.
6. All parking areas and driveways will be pave�l as shown on the
plot plan.
7. Curbs, �utters, sidewa:Lks, and structures sha11 be installed to
grades a;�d be constructed in accordance wii,h stand�.rcts specif�ed
by the Cii.;y Engineer.
8. Drainage within and w�thout the development shall be to the satis-
faction of ttie City Engir,eer.
�. Street improvements abut�ing the applicant's property shall be
�.ccording to City standards and speciiicatioi�s.
10. The applicant shall �e responsible for completing site as shown on
approved plot plan and shall be required to pay� for required
er�ineering, checking and in�pection fees prior to issuance of
Building Permit.
11, Landscaping shall be as approved and maintaa.ned as shown on plot pl�n,
12. Street widening an�i dedications shall be in accordance with street
widths approved b� City E�gineer.
