13. The use, within a Planned Development (P) Zone, shall be
d�esi�ned as Planned Industrial Park MP). The require-
ments and standards of Ordinance 002�x} of the City of
Cupertino shall apply, except where superseded by a con-
dition to this Use Permit 9-U-66.
14. Revised editions of the plan, profiles and tables attached
to the application shall be incorporated as Exhibits A,
C and D of Use Permit 9-U- These plans and profiles
shall incorporate changes caused by the conditions to this
Use Permit 9-U-66, and shall be followed in the detailed
design, except where revised as set forth in Condition 20.
15. The owner of the property described in this Use Permit
9'-U-6� must, at any stage of the development, provide
suffici�nt off-street parking and access lanes to accom-
modate the permanent working force_with�n the_a�ea, as
� well as any and al,l visitors . W�.dth of parking s,talls
shall be a minimum of nine �9) feet.
16. It shall be recognized, that future traffic engineering
studies may indicate the nece�sity of l�.miting traffic
movements at certain entrances and exits on Homestead Rd.
The Planning Com�ission has not studied the traffic pattern
into and out of these driveways, nor possible limitation
of traffic movements on Homestead Road, but will, at the
City Council's discretion, study the complete plan for
Homestead Road when that plan is forthcoming.

17. A�' wide walkway shall be constructed along the�east
side of Wolfe �o.ad, separated from the curb by a planted
strip, as designed by the landscape architect for the
development. �

RESOLUTION' OF THE PLANIVING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE GRANTING OF A USE PERMIT.
WHEREAS the Planning Commission of tYie City of Cupertino re-
ceived an application for a USE PERMIT, as stated on Page 2; and
WHE�EAS the applicant has met the burden of proof required to
support his said application; and
WHEREAS the Planning Commission finds that the application meets
the following requirements:
a. Encou�rages �the most appropriate use of land,
b. Conserves and:stabilizes.the value..of property,
c. Provides for adequate open�spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provid�es for the orderly development of the City, and
g. Is advantageous to the property and improvements in the
zoning district and neighborhood in which the property
is located;
NOW, THEREFORE, BE ST RESOLVED:
That after careful consideration of maps, facts, exhibits and
other evidence submitted in this matter, the granting of the
application for the USE PERMIT is hereby recommended, subject
to the conditions stated on Page 2 and Exhibit "B".
BE IT FURTHER RESOLVED:
That the aforem�ntioned find�.ngs be approved and.adopted, and
that the Secretary `be, and.is�.hex'eby directed to notify the
parties affected by this decision. �

18. All entrances and exits shall be constructed as curb returns
. They shall accommodate turns from and J
to the curb lane of adjacent streets.
19. Unless Road is widened to 90' as a County project,
applicable parts of Standard Conditions 1-12 shall be in
force. Under all circumstances, the owner of the property
described in this Use Permit 9-U-66 shall be responsible
for at least one-half of the cost of traffic signals and/or
other traffic devices necessitated by entrances to and exits
from the property along Homestead Road, except for the inter-
sections with Wolfe Road and Tantau Avenue.
20. Procedures for revisions of the Development Plan (Exhibits
A and C), or of the use of separate areas, shall be as
fo�lows:
a. Zn the event that the applicant shall desire to make
any change, alteration or amendment in the Development
Plan after it has been approved by the.City Council as
a condition to this Use Permit, � written request and
a revised Development Plan shall be submitted to the
City Planner. �
b. If the size and generaJ. location of buildings is not
increased, and the City Planner makes a finding that
the changes are minor and do not affect the general
appearance of the area or the interests of owners of
' property within or adjoining the Development Area, the
City Planner may certify the change on the revised plan.
If such approval is withheld, the applicant may appeal
to the Planning Commission.
c. If changes are material, but the requirements in the
Zoning Ordinance and previously imposed conditions are
still adhered to, and the total floor area of buildings
is not increased, the City Planner shall submit the
change to the Planning Commission. If the change is
denied by the Commission, the applicant may appeal to
the City Council, as provided in Ordinance 002(a) of
the City of Cupertino. �
d. �A change in the Development Plan including chan�e of
requirements or conditions, or an increase of the total
floor area of buildings, shall be processed as a new
application for a Use Permit.
