A Development Plan showing location and general type of buildings and general arrangemznt of parking and land- scapin� shall accompany the application for approval of a Tentative Map; or for a Building Permit, in case no Tentative Map is required. Adherence to a Development Plan approved by the Planning Commission shall be a condition to approval of Tentative Map and Building Permit. U1H��EAS, the attached application has been submitted to the City of Cupertino requesting a change of zone in the zoning regulations of the City, as stated on Page two; and WHEREAS, the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application; and W�-IEREAS, the Plannin� Commission has duly considered and heard all evidence submitted in regard to said application; and ti+IIIEREAS, the necessary public notices have been given as required by the Zoning Ordinance of the City of Cupertino; NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Commission finds that the proposed zone change: a. Encourages the most appropriate use of land, b. Conserves and stabilizes the value of property, c. Provides t adequate open spaces for light and air, d. Permits adequate control of fires, e. Promotes the health, safety and public welfare, f. Provides for the orderly development of the City, g. Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. 2. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. Said approval to be subject to the following conditions: Exhibit "B", which is composed of Conditions 1-12 quoted below: 1. Install ornamental street lights. Al1 lighting shall be designed to in no way interfere with ad�acent residential district. 2, Street trees will be planted in the public right-of-way and shall be of a type approved by the City in places designated by the City. 3. Traffic control signs will be placed at locations to be specif ied by the City. �. Fire hydrants shall be located as requested by the City. 5. A masonry wall will be built separating any commercial area from any residential area; which wall shall be six feet high above tne highest adjoining finished grade. 6. All parking areas and driveways will be paved as shown on �he plot plan. 7. Curbs, gutters, sidewalks, and structures shall be installed to grades and be constructed in accordance with standards specified by the City EY�gineer. 8. Drainage withyn and without the development shall be to the satis- faction of the City Engineer. 9, Street improvements abutting the applicant's property shall be according to Ci'cy standards and specifications. 10. The applicant shall be responsible for completing site as shown on approved plot plan and shall be required to pay for requir•ed engineering, checking and inspection fees prior to issusnce of Building Permit. 11. Landscaping shall be as approved and maintained as shown on p�ot plan� 12. Street widening and dedications shall be in accordance with s�reet widths approved by City Engineer. If the area is to be developed with parking in the rear, the facade towards Stevens Creek Blvd, shall be interrupted only by one vehicular entrance-exit. Other interruptions, for pedestrian passages or to create variation, shall be arranged or landscaped so as to screen the parking area from the Boulevard. 17. A combination of the aforementioned arrangements (3) and (L ) may be permitted by the Planning Commission. 18. Development may take place in stages, but the first stage shall include completion of municipal improvements along the entire frontage of Stevens Creek Blvd. and Miller Ave. If the area is intended to be developed asset forth under (3) above, the required 20 ft. wide strip of landscaping shall be completed along the entire frontage of Stevens Creek Blvd. 19, These conditions shall be stated in an appendix to the Zoning Map of the City of Cupertino under the heading "fa" ; and reference to the appendix shall be made on the Zoning Map itself by the lower-case letters "fa" ; as set forth in • Ordinance 220 (f) Sec. 55.2 , PASSED AND ADOPTED this 28th day of February, 1966, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioner(s) Frolich, Hirshon, Horgan, Traeumer, Johnson NAYS : .. _ None APPROVED: 1 Robert C .
