PC Reso 805 17-U-70 RESOLUTION N0. 805 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO GRANTING A USE PERMIT for an existing service station upon its annexation into the City of Cupertino APPLICANT: Phillips Petroleum Company ADDRESS: P. 0. Box 77003, San Francisco, California SUBMITTED: August 21, 1970 LOCATION: Southwest corner of Stelling Road and McClellan Road ZONING: County CN (Neighborhood Commercial) AREA: .788 +- Acre --------------------------------------------------------------------------------- CONDITIONS AND FURTHER FINDINGS: 1-12. Standard Conditions to the extent that they do not conflict with the special conditions as enumerated herein. In the event that a conflict does exist the special conditions as enumerated herein shall apply. 13. The granting of this use permit is conditional upon the continual upkeep and maintenance of the landscaped areas. 14. The use permit is granted for the land as described in the application and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A. 15. The location of all buildings, fences, roadways, parking areas, land- scaping, and other facilities or features shall be located substan- tially as shown on the plot plan submitted labeled Exhibit A, except or unless indicated otherwise herein. 16. Outlined parking spaces shall be provided on the site based on three (3) spaces for each service bay, automobiles awaiting service shall be parked within the designated spaces only. The locations of said spaces shall be approved by the Planning Department prior to painting. 17. Outdoor display merchandise, such as tire racks, stacks of tires, vending machines, etc. shall not be permitted. 18. Outdoor servicing of automobiles, other than the dispensing of gasoline and oil and replacement of minor parts such as water hoses, fan belts, etc. is not permitted. 19. Failure to comply with the conditions enumerated herein shall be deemed to be a violation of the use permit, and the Planning Commission may, as provided in Section 5 of Ordinance No. 002(a) revoke said permit. 20. In lieu of a six (6) foot masonry wall as required by Standard Condition No. 5, a six (6) foot visual barrier shall be erected subject to the approval of the Architectural and Site Approval Committee.
