A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
AMENDING CONDITION 16 OF PLANNING COMMISSION RESOLUTION N0. 795
WHEREAS, the Planning Commission of the City of Cupertino recommended the
granting of a Variance on August 10, 1970 to allow certain eave overhangs and
canopy projections for property located at the southwest corner of Homestead
Road and Saratoga-Sunnyvale Road. The property presently being owned by
Skaggs Payless Drug Stores.
WHEREAS, this recommendation was based on certain conditions set forth
in Resolution No. 795.
AND WHEREAS, upon review of said resolution the Commission finds that
Condition 16 needs further clarification.
NOW, THEREFORE, be it resolved by the Planning Commission of the City
of Cupertino, that Condition 16 of Planning Commission Resolution No. 795
is hereby amended to read as follows:
16. In the event construction has not begun on Parcel B within a period of
three (3) months, the applicant shall submit a landscape plan for the
unpaved building site to the Planning Commission for approval; upon
approval, said landscaping shall be installed.
PASSED AND ADOPTED at a regular meeting of the Planning Commission
of the City of Cupertino this 24th day of August, 1970 by the following
roll call vote:
AYES: Commissioners Buthenuth, Hirshon, Meyers, Irwin
NOES: None
ABSENT: Commissioner Puetz
