FURTHER FINDINGS:
1. The proposed gasoline pumps would not be a complimentary use to the
primary function of an existing convenience store, resulting in
conflicting independent uses on the site.
2. The proposed unattended gasoline pumps would lack the necessary controls
needed to ensure public safety.

PASSED AND ADOPTED this 13th day of April, 1970, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:

RESOLUTION OF THE PLANNING COMMISSION OF THE CiTY OF CUPERTINO
DENYING A USE PERMIT�
WHEREAS the Planning Commission of the City of Cupertino re-
ceived an application for a U�e Permit, as stated on Page 2;and
WHEREAS the applicant has NOT met the bu�den of proof required
to support his said application; and
WHEREAS the Planning Commission finds that the application
does NOT meet all of the following requirements:
a. Encourages the most appro�riate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light
and ai r,
d. Pe� adequate control �f fires,
e. Promotes the health, safety and public welfare,
f. Provides for tl�e orderly development of the City,
and
g. Is adcantageous to the pro�erty and improvements
in the zoning di�trict and neighborhood in which
the property i s loc�ated;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and
other evidence submitted in this matter, the application for
the USE PERMIT be, and the same is hereby denied; and
BE IT FURTHER RESOLVED:
That the finds quoted above and on page two be approved and
adopted, and that the Secretary be, and is hereby directed
to notify the parties affected by this decision.
