RESOLUTION OF THE PLANNING COMMISSION OF' THE CITY OF CUPERTINO
RECOMMENDING THE DENIAL OF A VARIANCE
WHEREAS the Planning Commission. of the City of Cupertino received an
application for a VARIANCE, as stated on Page 2, and
WHEREAS the applicant has NOT met the b�arden of proof required to
support his said application, and
WHEREAS the Planning Commission finds t'r:��.t �ne application doe� NOT
meet all of the following requirements:
l. That there are special conditions or exceptional characteristics
in the nature of the property to be affected, or that its loc�-
tion or its surroundings are such as wi11 permit the Commission
to make a determination that a literal enforcement of the Ordi-
nance would result in practical difficulties or unnecessary hard-
ships; and
2. That the granting of the apblication is necessary for the pre-
servation and enjoyment of substantial property rights; �,n�
3. That the granting of the application wi11 not materially affect
adversely the health or safety of pe��sons residing or working
in the neighborhood of the property wh�.ch is the subje�t of the
application, and that the use of said property in the manner
which it is proposed to b;e.used will r�ot be materially detri-
mental to the public welfare or i aju:r�_o�.zs +o the value of the
property or improvements �ocated �r :;::a.i�� surroundings o
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of m����, facts, exhibits and other
evidence submitted in this matter, the a��plication for the V�RIAN�E
be, and the same is, hereby NOT recommended for a�proval to the City
Couricil �f t;l�e City of Cupertino; and
BE IT FURTHER RESOLVED:
That the findings quoted above and on Page 2 a.re approved and adopted,
and that the Secretary be, and is hereby, direc�,ed to not�.fy the
parties affected by this decision.
