1 - 12 Standard Conditions.
13 That the service station shall be constructed
so that the entrance to the lube bays shall be
to the rear of the building and not visible
from Sar•atoga-Sunnyvale Road.
l� That the building permit shall not be issued for
the service station until the bonds for the street
improvements have been posted wi_th the city and
building permits valued in excess of $100,000
have been secured.
15 That the improvements on �he Rodrigues property
adjacent to Valley Green Drive be delayed until
such time as the Rodrigues property is developed.
16 That Mr. Rodrigues dedicate all necessary lands
for the use of the streets and public facilities.
17 That the irrigation be satisfactorily resolved
by the applicant with the staff including the
Public Works Department, Planning Department and
the City Attorney.
18 That no emergency opening of the service station
be permitted until all the improvements have been
accepted by the City.
19 That the buildings be exactly as shown on the
rendering and the plot plan and if there are any
major changes that the Planning Cor�mission be
approached with the request for same.

RESOLITTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
GRANTING A USE PERMIT.
WHEREAS the Planning Commission of the City of Cupertino received
an applicati�n for a USE PERMIT, as stated on page 2; and
WHEREAS the applicant has met the burden of proof required to
support said application; and
WHEREAS the Planning Commission finds that the application meets
the following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides f�r adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and impr�vements in
the zoning district and neighb�rhood in which the
property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and
cther evidence submitted in this matter, the application:for
the USE PERMIT be, and the same is hereby granted, subject to
the conditions stated on page 2; and
BE IT �FURTHER RESOLVED:
That the aforementi�ned findings be approved and adopted, and
that the Secretary be, and is hereby directed to notify the
pa.rties affected by this decision.
