13 Whereas better quality of a multiple residential ,develop-
ment, particularly more landscaped area, can better be
achieved on large parcels under a unified development
scheme, the parcel to be rezoned shall be developed in
accordance with a Development Plan approved by the
Planning Commission; the entire parcel shall constitute
one single lot, except for street dedications, and
consequently an exemption is made from the limitation
to twenty (20� dwelling units per lot required by
Ordinance 220�a-1� Sec. l:lc-2.
l� Whereas Mary Avenue is intended as a major thoroughfare,
with divided roadways and no parking lanes, there shall
be no vehicular access to and from Mary Avenue, except
opposite Lubec Street; all parking, including guest
p�rking, shall be provided within the residential parcel;
dedication and improvement of Mary Avenue shall be made
as required by the City Engine�r.
15 Whereas open area in the center of an apartment project
is considered of more value than a wide front yard, the
front yard along Mary Avenue may be reduced to ten �10�
feet.
16 The designation of the zone sh�ll be R3-2.2�rf, and it
shall be so indicated on the Zoning Map. Appendix A to
Ordinance 220(f� of the City of Cupertino shall be
amended by adding "rf = Al1 conditions and findings in
Resolution No. 520 of the Planning Commission of the
City of Cupertino shall apply."

ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City of Cupertino '
requesting a change of zone in the zoning regulations of the City, as stated
on Page 2; and
WHEREAS the Planning Commission has held at least one public hearing in re-
gard to the application on the date as noted on said application; and
WHEREAS the Planning Gommission has duly considered and heard a11 evidence
submitted in regard to said application; and
WHEREAS the necessary publ.ic notices have been given as required by the
Zoning Ordinance of the City of Cupertino;
NOW, 'I'ri�I�.:EFORE, BE IT RESOLVED:
1.� 'That the Planning Commission finds that the proposed zone change:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City,
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
2. That said P1.anning Commission, therefore, reports favorably to the
City Council in the matter of granting said zone change, Said
approval to be sub�ect to the following conditions:
Exh�bit "B", which is compo�ed of Conditions 1-12 quoted below:
l. Install ornamental street lights. All lighting shall be designed
to in no way interfere with ad�acent residential district,
2. Street trees will be planted in the public right-of-way and shall
be of a type approved by the City in places designated by the City.
' 3. Traffic control. signs will be placed at locations to be specified
by the City.
�-. Fire hydrants shall be located as requested by the City. _
� 5. A masonry wall will be built separating any commercial area from
any residential area; which waYl shall be six feet high above the
� ` highest ad�oining finished grade. .
6. All parking areas and driveways will be paved as shown on the plot
plan,
7. Curbs, gutters, sidewalks, and structures shall be installed to
grades and be constructed in accordance with standards specified
b� the City Engineer.
� 8. Drainage within and without the development shall be to the satis-
faction of the City Engirieer.
9. Street improvements abutting the applicant's property shall be
according to City stand�.rds an�. specifications.
10. The applicant shall be responsible for complet�ng site as shown
on approved plot plan and shall be required to pa.y for required
engineering, checking and inspection fees prior to issuance of
Building Permit. �
11. Landscaping shall be as approved and ma.intained as shown on plot plan.
12. Street widening and dedications shall be in accordance with street
widths approved by City Engineer. '
