ING THE GRANTING OF A ZONE CHANGI,
WHEREAS the attached application has beeri submitted t� the City of Cupertino ;
request3ng a change of zone in the zoning regulations of the City, as stated
on Page 2; and
WHEREAS the Planning Commission has rield at least one public hearing in re-
gard to the application on the date as noted on said application; and
WHEREAS the Planning C,ommission has duly considerec? and heard all evidence
submitted in regard to said application; and
WHEREAS the necessary public notices ha.ve been given as required by the
Zoning Ordinance of the City of Cupertino;
NOW, TH:EREFORE, BE IT RESOLVED:
1.� That the Planning Cornmission finds that the proposed zone change:
a. Encourages tne most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provic�es for adequate open spaces for ligh.t and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welf'are,
f. Provides foi� the orderly development of the City,
g, Zs advantagecus to the property and improvements in the zoning
district an� rieigh�orhood in which the property is located.
2. That said Plannin� Commis,�ion, trierefo��e, reports favorably to the
City Council in the matfer o�' granting said zone change. Said
approval to be cub�ect to the following conditions:
Exh�.bit "B", whi�.h is compo,�ed of Conditions 1-12 quoted below:
1. Install ornamenta]_ sf�reet Iights. All lighting shall be designed
to in no way interf�re with ad�acent resiciential district,
2-. Street trees will be planted in the public right-of-way and shall
be of a type approved by the City in places designated by the City.
3. Traffic control. signs will �� placed at locations to be specified
by the City.
4. Fire hydrants shall be locatea as requested by the City. ,
� 5, A masonry wall wa_1_1 be built separating any commercial area from
any residential area; which waYl shall be six feet high above the
` highest ad�oining finished grade.
6. All parking areas and driveways will be paved as shown on the plot
p1an,
7. Curbs, gutters, sidewal_ks, and structures shall be installed to
grades and be constructed in accordance with standards specified
b�r the City Engineer.
' 8. Drainage within and without the development shall be to the satis-
faction of the City Engineer.
9. Street improvements abutting the applicant's property shall be
according to City stand�.rds an�. spec�fications.
10. The applicant shall be responsible for complet�ng site as shown
on approved plot plan and shall be required to pay for required
engineering, checking and inspection fees prior to issuance of
Building Permit. '
11. Landscaping shall be as approved and ma.intained as shown on plot plan.
12. Street widening and dedica�ions shall be in accordance with street
widths approved by City Engineer. �
