RESOLUTION OF THE PLANNING COMMISSION 0�� THE CITY OF CUPERTINO RECOMMEND-
ING THE GRANTINu OF A ZONE CHANGE
WHEREAS the attached applica.tion has been submitted to the City of Cupertino
requesting a change of zone in the zoning regulations of the City, as stated
on Page 2; and
WHEREAS the Planning Commission has held at least one public hearing in re-
gard to the application on the date as noted on said application; and
WHEREAS the Planning Commission has duly c�nsidered and heard all evidence
submitted in regard to said application; and
WHEREAS the necessa.ry pu.blic notices have been given as required by the
Zoning Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED;
1. That the Planning Corrimission finds that the proposed zone change:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value �f property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires
e. Promotes the health, safety and public welfare,
f. Provides for tre orderly development of the City,
g. Is advantageoL�s to the property and improvements in the zoning
district and n�ighborhood in which the property is located.
2. That said Plarining Commission, theref�re, reports favorably to the
City Council in the matter of granting said zone change. Said
approval to be subject to the following conditions:
Exhibit "B"� which is composed of Conditioris 1-12 quoted below:
l. Install ornamental stree� l.ights. All lighting shall be designed
to in no wa.y interfere with adjacent residential district.
2. Street t.rees will be planted in the pu'plic right-of-way and shall
be of a type approved by the City in p1_aces designated by the City.
3. Traffic c�ntrol signs will be placed at 7_ocations to be specified
by the City.
�. Fire hydrants shall 'oe located as requested 'py the City.
5. A masonry wa11 wi=11 be �built separating any commercial area from
any residential area; which wall shall be six feet high above the
highest adjoining finishe� grade.
6. Al1 parking areas and drive�n�ays will be paved as shown on the plot
plan.
7. Curbs, gutters, sidewalks, and structures shall be installed to
grades and be constructed in accordance with standards specified
by the City Engineero
8. Drainage within ar�d without the development shall be to the satis-
faction of the City Engineer,
9. Street improvemer.�ts a.butting the applicant's property shall be
according to City standards and specifications.
10. The applicant sriall 'pe responsible for completing site as shown
on approved plot plan and shall be required to pay for required
engineerir��, checking and inspection fees prior to issuance of
Building Permit.
11. Landscaping shall 'pe as approved and maintained as shown on plot plan.
12. Street widening and dedications shall be in accordance with street
widths approved. by C,ity Engineer.
