OF THE PLANNING COMMISSION OF THE CITY OF CUPERTTNO
regarding the Resolution of the Board of Supervisors
of Santa Clara County regarding Land Uses requiring
public utilities and facilities.

The Planning Commission of the City of Cupertino appreciates the
referral of �he proposed Resolution of the Board of Supervisors
regarding land uses requiring public utilities and facilities,
and wishes to express the following opinions. The matter is
very important to Cupertino because there are several County
"islands" practically surrounded by the City, and particularly
because County and City areas are interwoven in the Foothill
Boulevard area to the extent of defying rational planning, in
spite of the good cooperation between the respective planning
staffs . ,
Most of these County "islands" are in areas where water from the
Cupertino Water Works is the only practical supply. City policy
requires annexation as a condition to servicing. However, the
granting of zoning, use permits and architec�tural and site
approval by the County authorites before annexation creates
difficulties in many respects, particularly those stated below.
ZONING AND USE PERMITS
County and City zoning requirements maintain different standards.
Specifically, 'the City requires more lot area per dwelling unit
than the County. Thus, rezoning before annexation results in
uses non-conforming with City zoning ordinances.
Spot zoning frequently commits a much larger area. Where County
and City areas are as intermixed as in the Foothill Boulevard
area, a County rezoning of a single lot may virtually decide the
zoning for adjacent City areas. Use Permits, particularly for
service stations, may be against City policy. A particular:dif-
ficulty is that the Foothill Boulevard area is already zoned to
such a density that it will be hard to supply adequate municipal
facilities; a rezoning which results in still higher density
will cost the City heavy future expenses.
STREET DEDICATIONS AND IMPROVEMENTS
There are several "paper streets" in the Foothill Boulevard area.
A more rational street system is hard to implement when a street
may cross the boundary line one or more times.
The City has strict requirements in regard to dedication and im-
provement of streets. The County's street standards may differ
in some respects.

ARCHITECTURAL AND SITE CONTROL
Standards and policies of the City's Architectural and Site Control
Committee may differ. If the County Committee requires from the
applicant a certificate of previous approval by t�e City, as has
been done recently, the applicant is subjected to some delay.
SUGGESTED AMENDMENT TO THE WORDING OF THE PROPOSED RESOLUTION
"WHEREAS rezoning or granting of Use Permits before annexation
usually results in uses non-conforming with the General Plan and
the Zoning Ordinances of the City to which the property will be
annexed; and"
�end of the NOW, THEREFORE paragraph� "....or where a County
area intermingles with the area of a City in such a way that an
orderly development is difficult without annexation."

at a regular meeting of the Planning Commission of the City of
Cupertino, State of California.
