RESOLUTION OF THE PLANNING COMP�IISSION OF THE CITY OF CUPERTINO
DENYING A USE PERMIT.
WNEREAS the Planning Commission o� the City of Cupertino re-
ceived an application for a Use Perniit, as stated on Page ?_;and
WHEREAS the applicant has NOT met the burden of proof required
to support his said application; and
WHEREAS the Planning Commission finds that the application
� does NOT meet all of the following requirements:
a. Encourages the most apprc�riate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light
and air, ,
d. Permit� adequate control of fires,
. e. Promotes the health, safety and public welfa�e,
f. Provides for tl�e orderly development of the City,
and
g. Is adcantageo�s to the proFerty and improvements
� in the zoning district and neighborhood in which
. the property is loc�ted;
NOW, THEREFORE, BE IT RESOLVED:
That�after careful consideration of maps, facts, exhibits and
other evidence submitted in this matter, the application for
the USE PERMIT be, and the same is he�eby denied; and
BE IT FURTHER RESOLVED:
That the finds quoted above and on page two be approved and
adopted, and that the Secretary be, and is hereby directed
to nofiify the parties affected by this decision.
