GRANTING OF A USE PERMIT for a 50-a.cre one-°amily Cluster Develop-
ment within a PC-H Zone, �

CUidDITIOrTS AND FU'RTHER FINDINGS :
1. WH�REAS a density of 16 units per gross acre is allowed by present
zoning; WHER�AS the density proposed by the applicant is approxi-
mately 7 units pe�� gross acre; and WHE'r�EAS study of similar one-
family Cluster Developments in the Ba.y Area, with the same or
slightly higher density indicates that a pleasant environment can
be created with this density, NOW THEREFORE be it resolved to
recommend to the City Council a Use Permit for. a one-family Clus-
ter Development, with an average density of seven (7) dwelling
units per gross acre and no more than �20 dwelling units in the
indicated area, in general accordance with application 8-U-65,
as presented during the Planning Commission meeting September 13,
1965 with the following conditions:
2� The use shall be designated R1C within a PC-H zone, this desig-
nation being the proper standardized symbols recommended by the
Santa Clara County Inter-City Council; the requirements in the
Cluster Ordinance shall apply, with the followin� exceptions:
(a) Front yard may be reduced to the width shown in approved
detailed development plans.
(b) Distance between buildings may be reduced to the width
shown in approved detailed development plans; but not
in more cases than shown on the plan attached to the
present application; and provided that transparent
windows in buildings on different lots do not oppose
each other at less distance than 14 ft. if both build-
ings are one-story, 29 ft, if one or both of the
buildings are two-story.
3, The internal stree�s shall connect with Mary Avenue at two points,
located approximately as shown on the applic�rit's plan; there
shall be no direct access from lots to Mary Avenue, except that
entrance and exit for a street or driveway serving the indicated
model homes will be allowed.

GRANTING A USE PERMIT. �
WHEREAS, the Planning Commission of the City of Cupertino
received an application for a USE PERM:LT, as stated on page two; and
WHEREAS, the applicant has met the burdern of proof required
to support his said application; and
WHEREAS, the Plann3.ng Commission .finds that the application
meets the following reauirements<
a. Encourages the most appro�riate use of land,
b. Conserves and stabilizes the value of property,
c. Prov3des for adeguate open spaces for li�ht and air,
d. Permits adec�uate control of fires,
e. Promotes the health, safety and public uielfare,
f. Provides for the orderly developm�nt of the City, and
g. Is advantageous to the property and improvements in the
zoning district and nei�;hborhood in which the property is
located;
NOW, THEREFORE, BE I`S RESOLVED:
That after careful considerati�n of maps, facts, exhibits and
other evidence submitted in this matter, the appl3.cation for the USE
PERMIT be and the same is hereby granted, sub,�ect to the conditions
stated on page tv�zo; and
BE IT.FURTHER RESOLVED:
That �he aforementioned f inc?ings be approved and adopted, and
that the Secretary be, and is hereby directed to notify the parties
affected by this decision.

CONDIT�ONS AND FURTHER FINDINGS (continued):
5, The section of Mary Avenue shall be decided as a part of the
processing of a Tentative Map of the area, and after study of
the consequences of the recent decision by the City of Sunnyvale
on the continuation of Mary Avenue. If it were decided to retain
the possibility to connect Mary Avenue over the Junipero Serra
Freeway, the cross-section shall consist of four moving lanes,
each 12' wide, plus shoulders, median strip, and left turn
facilities, to the satisfaction of the Director of Public Works
and the Director of Planning.
6. The cross-sections of internal streets shall be in accordance
with the plan submitted by the Director of Public UTOrks.
7. Walkways within the Common Area may be substituted for sidewalks;
except that two sidewalks shall be provided along the internal
street at the southerly connection with Mary Avenue, to a length
of 350 ft.; and one sidewalk along the internal street of the
northerly connection with Mary Avenue, to a length of 250 ft.;
and that all streets noted A-A on the map presented by the
Director of Public ti�lorks shall have sidewalks on one side, namely
the internal street connecting the in�;ersections in Mary Avenue,
and the easterly loop street.
8. The applicant shall submit to the Planning Commission from ti.me
to time detailed developrnent plans for sections of the area for
which the Use Permit has been granted. These detailed plans
shall indicate landscaping and dimensions of open green areas,
The plans shall be considered a continuation of Use Permit
8-U-65, and �hall be submitted prior to or concurrent with a
Tentative Map covering at least the area included in the plans.
9. Proposed Covenants for the development and maintenance of the
Common Area shall be submitted together with the firs� of the
detailed deve�.opment plans mentioned in the above paragraph,
10. Underground public utilities shall be provided.
11. The developer shall provide surface easement to the open areas,
and consent of the City must be ob�ained for the building of
any structures thereon.
