N�NDING THE GRANTING OF A VARIAI�TCF ,
WHEREAS, the Planning Commission of the City of Cupertino
received an application ��r a VARTANCE, as stated on page two; and
WHEREAS, the applicant has nzet the burden of proof reauired to
su�port his said application; and
WHEREAS, the ap�lication shoU�s:
1. That there are special conditi�ns or. exceptional characteris-
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surroundings are such as will permit the Commission to
make a determinat3on that a literal enforcement of the Ordinance would
result in practical. diff iculties or unnecessary hardships; and
2. That the granting of the application is necessary for the
preservation and enjoyment of substantial proper�ty rights; and
3. That the hearings show that the granting of the application
wi11 not materially affect adversely the health or safet,y of persons
residing or working in the neighborhood of the pro�erty t�1hich is the
sub�ect of the application, and that the use of said property in the
manner which it is proposed to be used will not be materially detri-
mental to the public welfare or injurious to the value of property or
imprc�vements l:�cated in said surroundings;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consiueration of maps, facts, exhibits and
other ev3c�ence submitted in this matter, the application for the
VARIANCE be, anc�. the same is, hereby recommended for approval to the
City Council of the City �f Cuperf,ino for appropr. iate action, sub ject
