I�NDING THE GRANTIPIG OP A VA�i.IANC.r .
WHEREAS, the Planning Commission of tY City of Cupertino
received an application for a Z��ARiANCE, as si;ated on page two; and
WHEREAS, the applicant has met the burden of proof req_uired to
support his said application9 and
WHEREAS, the applicati�n shows:
l, That there are special conditi�ns or exceptiona], characteris- _.
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surroundings are such as wi11 permit the Commission to
make a determination that a literal enforcement of the Ordinance would
result in practical diff iculties or unnecessary hardships; and
2. That the granting of the application is necessary for the
preservation and enjoyment of subst�ntial pr�oper�ty rights; and
3. That the hearings show that tr.e granting of the application -
v�Till not ma�erially affect adversely the health or safety of persons
residing or working in the neighborhood of the property which is the
sub�ect of the application, and that the use of said property in the
manner which it is proposed to be used will not be materially detri-
mental to the public welfare or injurious to the value of property or
improvements located in said surrounding�;
NOW, THEREFORE, BE IT RESOLVED: -�
That after careful consideration of maps, facts, exhibits and
other eviclence submitted in this matter, the ai�plication for the

City Council of the City �f Cuperi;ino for �p��ropriate action, subject
to the conditions stated on page liU�: and
BE IT FURTHER RESOLVED:
That the aforer�entioned findings are approved and adopted, and
that the Secretary be, and is hereby, directed to notify the parties
affected by this decision.
