Agreement with the City.
2. The sign shall not encroach over the sidewalk, and shall
be located tl�ree (3) feet closer to the roadway than
presently proposed.

RESOLUTION OF THE PLANNING COMMISSION OF TfIE CITY OF CUPERTINO RECOM-
N�NDING THE GRAN�I'ING OF A VARIANC� .
tiaHEREAS, the P�anning Commission of the City of Cupertino
received an application for a VARIANCE, as stated on page two; and
WHEt�EAS, the applicant has met the burden of proof reauired to
support his said application9 and
WHEREAS, the ap�lication shov��s :
l. That there are special conditi�ns or exceptional characteris-
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surroundings are such as will permit the Commission to
make a determination that a literal en�orcement of the Ordinance would
result in practical diff iculties or unnecessary hardships; and
2. That the granting of the application is r.ecessary for the
preservation and enjoyment of substantial property rights; and
3. That the hearings show thut tr.e granting of the upplication
v��ill not materially affect adversely the heal'ch or safety of persons
residing or working in the neighborhood of the property UThich is the
sub�ject of the at�plication, and that the use of said property in the
manner which it is proposed to be used wi11 not be materially detri-
mental to the public Welfare or injurious to the value of property or
improvements located in said surrounc�in�s;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and
other evic�ence submitted in this matter, the ai�plication for the
VARIANCE be, anc� the s�me is, hereby recommended for approval to the
City Council of the City �f Cupertino for appropriate action, subject
to the conditions stated on �age tv�o; �nd
BE IT FURTHER RESOLVED:
That the aforer�entioned findings are approved and a�opted, and
that the Secretary be, and is hereby, directed to notify the parties
affected by this decision.
