RESOLt1TI0N OF THE PLANNING COMMISSION OF T�� CIZ`Y OF CUPERTINO RECOM-
P�NDING THE GRANTING OF A VARIANCF.
WHEREAS, the Planning Commission of the City of Cupertino
rec,eived an application for a VARIANCE, as stated on page two; and
WHEREAS, the applicant has met the burden �f proof reauired to
support his said app�ication; and
WHEREAS, the application shoU�s:
1, That there are special condi�i�ns or exceptional characteris-
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surroundings are such as will permit the Commission to
make a determination that a literal enforcement of th� Ordinance would
result in practical difficulties or unnecessar�r hardships; and
2. That the granting of the application is recessary for the
preservation and enjoyment of substantial property rights; and
3. That the hearin�s shotiv that the granting of the upplication �
v��ill not ma�eriall�T affect adversely the health or safety of persons
residing or working in the nei�hborhood of the property t��hich is the
sub�ect of the application and that the use of said property in the
manner which it is proposed to be used will not be materially detri-
mental to the public welfare or injurious tothe value of property or
improvements l�cated in said surroundings;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and
other evidence submitted in this matter, the ai�;�lication for the
VARIANCE be and the sGme is, hereby recommended for approval to the
City Council of the City �f Cupertino for appropri�te action, sub,ject
to the conditians stated on page tU?o; and
BE IT FURTHER RESOLVED:
That the aforer�entioned findings are approved �nd adopted, and
that the Secretary be, and is hereby, directed to notif y the parties
affected by this clecision.
