WHER AS, the Planning Commission of the City of Cupertino received an applicati�n for a USE FERMIT, as stated on page two; and WHEREAS, the applicant has met the burdern of proof required to support his said application; and WHEREAS, the Planning Commission finds that the application meets the fo1loU�ing requirementse a. Encourages the most appropriate use of land, b. Conserves and stabi�izes the value of pro�erty, c. Provides for adequate open spaces for light and air, d. Permits adequate control of fires, e. Promotes the health, safety and public welfare, f. Provides for the orclerly development of the City, and g. ' 17 All utilities shall be underground. 18 Procedure for revisions Ys as follot•rs: In the event that the applicant s�all desire to make any change, alteration or amendment in the Development Plan after it has been approved by the City Council as a con- dition to this Use Permit, a w�itten request and a revised Development Plan shall be submitted to the City Planner. If the size and general location of buildings is not.in- creased, and the.City Planner makes a finding that the changes are minor and do not affect the gene.ral appearance of the area or the interests of owners of property within or adjoininn the Development Area, the Ci�ty Planner may certify the change on tl revised plan. If such approval is withheld, the.applicant may appe�al to the Planning Commission. If changes are material, but the�requirements in the Zoning Ordinance and previously imposed conditions are still adhered to, and the total floor area of buildings is not increased, the City Planner shall submit the change to the Planning Commission.
