WHER AS, the Planning Commission of the City of Cupertino
received an applicati�n for a USE FERMIT, as stated on page two; and
WHEREAS, the applicant has met the burdern of proof required
to support his said application; and
WHEREAS, the Planning Commission finds that the application
meets the fo1loU�ing requirementse
a. Encourages the most appropriate use of land,
b. Conserves and stabi�izes the value of pro�erty,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orclerly development of the City, and
g. Is advantageous to the property and improvements in tPie
zoning district and neighborhood in w�hich the property is
locat�d;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, f acts, exhibits and
other evidence submitted in this matter, the application for the USE
PERMIT be, and the same is hereby granted, sub�ect to the conditions
stated on page two; and
BE IT FURTHER RESOLVED:
That the aforement3.oned f indings be approved and adopted, and
that the Secretary be, and is hereby directed to notify the parties
affected by this decision.

18 Procedure for revisions Ys as follot•rs:
In the event that the applicant s�all desire to make any
change, alteration or amendment in the Development Plan
after it has been approved by the City Council as a con-
dition to this Use Permit, a w�itten request and a revised
Development Plan shall be submitted to the City Planner.
If the size and general location of buildings is not.in-
creased, and the.City Planner makes a finding that the
changes are minor and do not affect the gene.ral appearance
of the area or the interests of owners of property within
or adjoininn the Development Area, the Ci�ty Planner may
certify the change on tl revised plan. If such approval
is withheld, the.applicant may appe�al to the Planning
Commission.
If changes are material, but the�requirements in the Zoning
Ordinance and previously imposed conditions are still adhered
to, and the total floor area of buildings is not increased,
the City Planner shall submit the change to the Planning
Commission. If the change is denied by the Commission, the
applicant may appeal to the City C�uncil, as provided in
Ordinance 002(a) of the City of Cupertino.

18 Procedure for revisions (continued)
A change in the Development Plan including change of
requirements or conditions, or an increase of the total =�_,
floor area of buildings, shall be processed as a new
application for a Use Permit.
19 �Adherence to the presented Development Plan is a condition
to the granting of this Use Permit.
20 That easement for access through the area south of the
property be acquired.
PASSED AND ADOPTEL this 26th day of April, 1965, at a regular
meeting of the Planning Commission of the City of Cupertino, 5tate of
