WHEREAS, the Planning Comm�.ss:ion of the City of Cupertino received an application for a VARZANC�, as stated on page two; and WHF'REAS, the applicant has NOT met tYie burden of proof required to support his said applicati�n; WHEREAS, the Planning Commission finds that the application does NOT meet all of the fo11oU1ing requirements: 1. That there are special conditions or exceptional character- istics in the nature of the property to b� affected, or that its location, or its surroundings are such as will permit the Commission to make a determination that a literal enforcement of the Ordinance woul.d result in pract3.cal difficulties or unnecessary hardships; and 2. That the granting of the application is necessary for the preservation and enjoyment of substantial property rights; an�. 3.
