RESOLUTION OF THE PLANNING COMMISSION OF T�� CITY OF CUPERTINO RECOM-
Ni�NDING THE GRANTING OF A VARIANCF.
WHEREAS, the P�anning Commission of the City of Cupertino
received an application f�r a VARIANCE, as stated on page two; and
WHEREAS, the applicant has met the burden �f proof reauired to
support his said applica�ion9 and
WHEREAS, the application sho���s:
1, That there are special condi�i�ns or exceptional characteris-
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surrounding;� are such as will permit the Commission to
make a determination that a literal enforcement of the Ordinance would
result in practical diff iculties or unnecessary hardships; and
2. That the granting of the application is r.ecessary for the
preservation and enjoyment of substantial proper�ty rights; and
3. That the hearings show that tr.e granting of the application
v��ill not materially affect adversely the health or safe�y of persons
residing or v��orking in the nei�hborhood of the pro�erty z��hich is the
subject of the ar�plication and that the use of said property in the
manner which it is proposed to be used U�ill not be materially detri-
mental to the public welfare or injurious to the value of property or
improvements located in said surroundings;
NOW, THEREFORE, BE IT RESOLVEDo
That aiter careful consid_eration of maps, facts, exhibits and
other evidence submitted in this matter, the ai��lication for the
VARIANCE be, anc? the s�me is, hereby recommended for approval to the
City Council of the City �f Cupertino for appropriate action, subject
to the conditions stated on �a�e tUao; and
BE IT FURTHER RESOLVED:
That the aforer�entioned findings are approved �nd adopted, and
that the Secretary be, and is nereby, directed to notify the parties
affected by this decision.
