RESOLUTION OF THE PLANNING COMNISSION OF T�� CITY OF CUPERTINO RECOM-
1'�NDING THE GRANTING OF A VARIANCF.
WHEREAS, the Planning Commission of the City of Cupertino
received an application f�r a VARTANCE, as stated on page two; and
WHEREAS, the applicant has met the burden �f proof reauired to
support his said application; and
WHEREAS, the applicati�n shows:
1. That there are special conditi�ns or exceptional characteris-
tics in the nature of the property to be affected, or that it's loca-
tion, or it's surroundings are such as will permit the Commission to
make a t�e�ermination that a literal enforcement of the Ordinance would
result 3.n practical difficulties or unnecessar,y hardships; and
2. That the granting of the application is necessary for the
preservation and enjoyment of substantial proper��y rights; and
3. That the hearings show that th.e granting of the upplication �
v��ill not materially affect adversely the health or safety of persons
residing or working in the reighborhood of tne proper�y which is the
sub,ject of the application, and that the use of said property in the
manner which it is proposed to be used U:.ill not be materially detri-
mental to the public welfare or injurious to the value of property or
improvements located in sai�. surrounclings;
NOW, THEREFORE, BE IT RESOLti�D:
That after careful consideration of maps, facts, exhibits and
other evic�ence submitted in this matter, the aj�l�lication for the �
VARIANCE be, and the s�me is, hereby recommended for approval to the
City Council of the City �f Cupertino for �ppropriate action, subject
to the conditions stated on page t��o; and
BE IT FURTHER RESOLVED:
That the aforeMentioned findings are approved Gnd ad_opted, and
that the Secretary be, ancl is hereby, directed to notify the parties
affected by this decision.
