MINUTES OF STUDY SESSION OF THE PLANNING COMMISSION
HELD JANUARY 22, 1969 IN THE LIBRARY ROOM, CITY HALL
CUPERTINO, CALIFORNIA
Present: Commissioners Irwin, Hirshon, Buthenuth, Puetz, Frolich.
Senior Planner Laurin and Assistant Planner Eng.
Senior Planner Adde Laurin made a short reiteration of previous research on
performance standards for industrial zones, Many cities and agencies have
been contacted. None of the contacted cities depend solely on performance
standards, and there are few occasions where the standards have been the
base for corrective action; however, the inclusion of the standards in
ordinances may have discouraged undes.irable development. Regulati.ons by
agencies such as the Bay Area Air Pollution Control Board are intended to
prevent overall pollution of a large area rather than discern between heavy
and light industry in a community.
Mr. Laurin presented three pages of suggested performance standards written
in ordinance form. However, because of lack of experience in the Bay area
in enforcement of such standards, he could not guarantee .that the indicated
quantities were the right ones for separating light industry from heavy
industry. Performance standards in zoning are desirable, and it is a
challenging project, but we are largely on our own.
The Commissioners were enthusiastic about the idea that Cugertino would
innovate a modern ordinance, and several of the Commissioners promised to
contribute with research and field work.
In discussing the details of the Senior Planner's draft, the following
notes were made:
1. There should be different standards at the boundary between two
individual lots and at the boundary to another zone.
1f. A regulation should prevent dissimination of heavy gases which
collect at ground level.
li Add "corrosive discharge".
Add "can damage sewer lines".
1. Add paragraph either prohibiting or requiring Use Permit for
commercial manufacture of radioactive material (excluding for
use in laboratories on the premises.
