RESOLUTION OF �`HE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE DENIAL OF A VARIANCE
WHEREAS t�e Pla�nning Commission of the City of Cupertino re-
ceived ar� application for a VARIANCE, as stated on Page 2, and
WHEREAS the applicant has NOT met the but of proof required
to suppo� his said application, and
WHEREAS the Plar�r�i�ng Commission finds that the application does
NOT meet all of the fo1lowing requirement�.
1, That the�°e a�e special conditions o�° exceptional character-
istics in �he natUre of the proper�ty �o be affected, or
that its loca�ion or� its sur�roundings ar°e �uch as will per-
mit the Commi�sion �o make a dete� that a literal
enforcemen�t of the rdinance would �°esult in pr°actical
difficulties or unn�cessary hardJhips; and
2. That the g�°anting of the application is necessary for the
preservatio� and enjoymer�t of substantial property rights,
and
3, That the gr°anting of the application will not materially
affect adver�sely the health or safety of per�ons residing
or wo�king in the neighborhood of the property which is
the subject of the application, and that the use of said
property i n the ma,nr�er° which i t i s proposed to be used
will not �ae materially detrimental to the public welfare
or inju� to the value of the proper�y or improvements
located in said suirroundings,

the VARIANCE be, and the same is, hereby NOT recommended for
